                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further defining "public servant"; and
     3     further providing for the offense of impersonating a public
     4     servant.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The definition of "public servant" in section
     8  4501 of Title 18 of the Pennsylvania Consolidated Statutes is
     9  amended to read:
    10  § 4501.  Definitions.
    11     Subject to additional definitions contained in subsequent
    12  provisions of this article which are applicable to specific
    13  chapters or other provisions of this article, the following
    14  words and phrases, when used in this article shall have, unless
    15  the context clearly indicates otherwise, the meanings given to
    16  them in this section:
    17     * * *
    18     "Public servant."  Any officer or employee of government,

     1  including members of the General Assembly and judges, and any
     2  person participating as juror, advisor, consultant or otherwise,
     3  in performing a governmental function; but the term does not
     4  include witnesses. The term includes any municipal police
     5  officer and any officer of the Pennsylvania State Police.
     6     Section 2.  Section 4912 of Title 18 is amended to read:
     7  § 4912.  Impersonating a public servant.
     8     A person commits a [misdemeanor of the second] felony of the
     9  third degree if he falsely pretends to hold a position in the
    10  public service with intent to induce another to submit to such
    11  pretended official authority or otherwise to act in reliance
    12  upon that pretense to his prejudice.
    13     Section 3.  This act shall take effect in 60 days.
