HOUSE BILL

        INTRODUCED BY NICKOL, GEIST, MASLAND, WAUGH, OLASZ, HERSHEY,
           ARMSTRONG, FARGO, STABACK, LYNCH, STERN, PETRARCA, PLATTS,
           YOUNGBLOOD AND McNAUGHTON, NOVEMBER 3, 1997

                                     AN ACT

     1  Amending Title 24 (Education) of the Pennsylvania Consolidated
     2     Statutes, further providing for applicability of chapter.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 6501(b) of Title 24 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 6501.  Applicability of chapter.
     8     * * *
     9     (b)  Exceptions.--Notwithstanding subsection (a), this
    10  chapter does not apply to any:
    11         (1)  Incorporated or unincorporated theological seminary
    12     without power to confer degrees.
    13         (2)  Public instrumentality subject to the policy
    14     supervision and direction of the State board.
    15         (3)  Religious degree-granting institution which
    16     certifies, in accordance with procedures established by the
    17     department, that it:


     1             (i)  Is founded and operated by a church or
     2         organization of churches as an integral part of the
     3         religious ministry of that church or organization.
     4             (ii)  Offers sectarian instruction only designed for
     5         and aimed at persons who hold or seek to learn particular
     6         religious faiths or beliefs of churches or religious
     7         organizations and provides only educational programs for
     8         religious vocations.
     9             (iii)  States on the diploma or degree the religious
    10         nature of the degree.
    11         (4)  Church or other religious institution offering a
    12     post-secondary instructional program leading to a diploma or
    13     certificate only if designed for and aimed at persons who
    14     hold or seek to learn the particular religious faith or
    15     beliefs of that church or religious organization and
    16     providing only educational programs for religious purposes.
    17     Section 2.  This act shall take effect in 60 days.
