                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     impersonating a law enforcement officer; and providing for
     4     suspension of operating privileges.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4912 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 4912.  Impersonating a public servant.
    10     (a)  Law enforcement officers.--A person commits a felony of
    11  the third degree if he pretends to be a law enforcement officer
    12  by displaying a badge with the intent to induce another to
    13  submit to such pretended official authority or otherwise to act
    14  in reliance upon that pretense to his prejudice.
    15     (b)  Other public servants.--A person commits a misdemeanor
    16  of the second degree if he falsely pretends to hold a position
    17  in the public service with intent to induce another to submit to


     1  such pretended official authority or otherwise to act in
     2  reliance upon that pretense to his prejudice.
     3     Section 2.  Title 18 is amended by adding a section to read:
     4  § 4912.1.  Suspension of operating privileges.
     5     (a)  General rule.--Whenever a person is convicted for a
     6  violation of section 4912 (relating to impersonating a public
     7  servant), the court shall order the operating privilege of the
     8  person suspended. A copy of the order shall be transmitted to
     9  the Department of Transportation.
    10     (b)  Duration of suspension.--When the department suspends
    11  the operating privilege of a person under subsection (a), the
    12  duration of the suspension shall be for a period of one year
    13  from the date of suspension.
    14     (c)  Nondrivers.--Any person whose record is received by the
    15  department under subsection (a) and who does not have a driver's
    16  license shall be ineligible to apply for a learner's permit
    17  under 75 Pa.C.S. §§ 1505 (relating to learners' permits) and
    18  1507 (relating to application for driver's license or learner's
    19  permit by minor) for the time periods specified in subsection
    20  (b).
    21     (d)  Insurance premiums.--An insurer shall not increase
    22  premiums, impose any surcharge or rate penalty or make any
    23  driver record point assignment for automobile insurance, nor
    24  shall an insurer cancel or refuse to renew an automobile
    25  insurance policy on account of a suspension under this section.
    26     Section 3.  This act shall take effect in 60 days.
