        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, FEBRUARY 9, 1998

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Department of Environmental
     3     Protection and the Governor, to sell and convey to Marc G.
     4     and Susan K. Springman, certain land situate in Old Lycoming
     5     Township, Lycoming County, Pennsylvania; and authorizing and   <--
     6     directing the Department of General Services, with the
     7     approval of the Governor, to convey tracts of land and
     8     buildings, consisting of a portion of the former Laurelton
     9     Center, located in Hartley Township, Union County,
    10     Pennsylvania.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  (a)  The Department of General Services, with the  <--
    14  approval of the Department of Environmental Protection and the
    15  Governor, is hereby authorized and directed on behalf of the
    16  Commonwealth of Pennsylvania to grant, sell and convey to Marc
    17  G. and Susan K. Springman for consideration in the amount of
    18  $375 the following tract of land and buildings.
    19     The property to be conveyed is the following tract of land
    20  situate in Old Lycoming Township, Lycoming County, Pennsylvania,
    21  bounded and described as follows:


     1     Beginning at an existing iron pin, at the intersection of the
     2  southern right-of-line of Chatham Lane (also known as Township
     3  Road, No. 430) and the northeastern corner of land of Lycoming
     4  Creek Realty Company, Inc., said beginning point being north 84
     5  degrees 54 minutes 40 seconds east 262 feet from a point, at the
     6  intersection of the southern right-of-way line of said Chatham
     7  Lane, projected (also known as Township Road, No. 430) and the
     8  center of Pennsylvania State Highway, State Route No. 0015 (also
     9  known as Lycoming Creek Road).
    10     Thence from the said place of beginning and continuing along
    11  the southern right-of-way line of said Chatham Lane (also known
    12  as Township Road, No. 430) north 84 degrees 54 minutes 40
    13  seconds east 31.87 feet to an iron pin, at the intersection of
    14  the southern right-of-way line of said Chatham Lane (also known
    15  as Township Road, No. 430) and the northwestern corner of land
    16  of the Commonwealth of Pennsylvania, Flood Control Bureau,
    17  District No. 13, Parcel No. 13OL-528. Thence along the western
    18  line of land of the Commonwealth of Pennsylvania, Flood Control
    19  Bureau, District No. 13, Parcel No. 13OL-528, south 5 degrees 39
    20  minutes 40 seconds east 13.37 feet to an iron pin, at the
    21  intersection of the southeastern corner of land of the
    22  Commonwealth of Pennsylvania, Flood Control Bureau, District No.
    23  13, Parcel No. 13OL-528, and the northern line of land of Marc
    24  G. and Susan K. Springman. Thence along the northern line of
    25  land of said Marc G. and Susan K. Springman, north 85 degrees 10
    26  seconds west 33.98 feet to an existing iron pin, at the
    27  intersection of the northwestern corner of land of said Marc G.
    28  and Susan K. Springman and the eastern line of land of the
    29  aforesaid Lycoming Creek Realty Company, Inc. Thence along the
    30  eastern line of land of said Lycoming Creek Realty Company,

     1  Inc., north 5 degrees 58 minutes 20 seconds east 7.56 feet to
     2  the place of beginning.
     3     Containing 341 square feet.
     4     (b)  The Department of General Services, with the approval of  <--
     5  the Governor, is hereby authorized and directed, on behalf of
     6  the Commonwealth of Pennsylvania, to grant and convey the
     7  following described tracts of land and the improvements erected
     8  thereon:
     9     All those certain tracts or parcels of land, with
    10  improvements thereon erected, situate in Hartley Township, Union
    11  County, Pennsylvania, more particularly bounded and described as
    12  follows:
    13                              TRACT 1
    14     Beginning at an existing steel pin and stones located on or
    15  near the northern right of way of S.R. 0045 and on the
    16  jurisdictional division line between lands of the Commonwealth
    17  of Pennsylvania, Bureau of Forestry and lands of the
    18  Commonwealth of Pennsylvania, Department of Public Welfare.
    19     Thence along lands of the Commonwealth of Pennsylvania,
    20  Bureau of Forestry by the 4 following courses and distances;
    21     1.  North 22 degrees 29 minutes 55 seconds East, 3685.15
    22  feet, to an existing witnessed stone pile;
    23     2.  North 74 degrees 47 minutes 54 seconds East, 831.53 feet,
    24  to an existing witnessed stone pile;
    25     3.  South 75 degrees 02 minutes 58 seconds East, 143.22 feet,
    26  to a point east of Stony Run Road;
    27     4.  South 25 degrees 32 minutes 58 seconds East, 1472.86

     6  feet East of the intersection of S.R. 0045 and S.R. 0235 and
     7  being on or near the southern right of way line of S.R. 0045 and
     8  on the division line between lands of the Commonwealth of
     9  Pennsylvania and lands of Arlon E. Wallace and Crystal A.
    10  Heeter.
    11     1.  Thence along lands of Arlon E. Wallace and Crystal A.
    12  Heeter and lands of Bradley F. Walter and Angelia Walter South
    13  08 degrees 15 minutes 05 seconds West, 1253.61 feet, to an
    14  existing twin oak tree;

    18  21 minutes 49 seconds, and a chord of South 65 degrees 29
    19  minutes 18 seconds East, 192.28 feet to an existing steel pin,
    20  the point and place of beginning.
    21  Tract 2 containing 64.428 acres as above described.
    22                              TRACT 3
    23     Beginning at an existing steel pin located approximately 1180
    24  feet West of the intersection of S.R. 0045 and S.R. 0235 and
    25  being on or near the southern right of way of S.R. 0045 and on
    26  the jurisdictional division line between lands of the
    27  Commonwealth of Pennsylvania, Department of Conservation and
    28  Natural Resources and lands of the Commonwealth of Pennsylvania,
    29  Department of Public Welfare.
    30  Thence along lands of the Commonwealth of Pennsylvania,

     1     Section 2.  The two tracts under section 1(b) or parts
     2  thereof may be offered together or separately.
     3     Section 3.  Notwithstanding the Surplus Property Disposition
     4  Act 71 ps. 2401-A et seq., as amended by Act 1981-48, the
     5  Department of General Services shall, through sealed bids,
     6  auction or request for proposal select the purchaser of the
     7  tracts and sell the property under section 1(b). Acceptance of
     8  an offer shall be subject to a minimum price requirement as
     9  established by the department which shall be within a range of
    10  fair market value as established through independent appraisal.
    11  Proposals submitted in response to a request for proposal must
    12  demonstrate a value to the Commonwealth equivalent to the fair
    13  market value range as established by the department through
    14  independent appraisal. In establishing the value equivalent the
    15  department shall consider the following factors: actual monetary
    16  consideration, creation of construction jobs, creation of
    17  permanent jobs, expansion of local tax base, economic growth,
    18  community development, highest and best use, and public purpose.
    19     Section 4 2.  The conveyances CONVEYANCE shall be made under   <--
    20  and subject to all easements, servitudes and rights of others,
    21  including, but not confined to, streets, roadways and rights of
    22  any telephone, telegraph, water, electric, sewer, gas or
    23  pipeline companies, as well as under the subject to any
    24  interest, estates or tenancies vested in third persons, whether
    25  or not appearing of record, for any portion of the land or
    26  improvements erected thereon.
    27     Section 5 3.  The proceeds of the sale under section 1(a)      <--
    28  THIS SALE shall be paid into the State Treasury and deposited in  <--
    29  the General Fund.
    30     Section 6 4.  The deeds DEED of conveyance shall be approved   <--

     1  as provided by law and shall be executed by the Secretary of
     2  General Services in the name of the Commonwealth of
     3  Pennsylvania.
     4     Section 7.  (a) SECTION 5.  Costs and fees incidental to the   <--
     5  conveyance under section 1(a) shall be borne by the grantee.      <--
     6     (b)  The cost and fees incurred by the Department of General   <--
     7  Services for preparing the property under section 1(b) for sale,
     8  including, but not limited to, environmental assessments,
     9  marketing services, title searches, advertising, appraisals,
    10  auctioneer fees and surveys, and by the Department of Public
    11  Welfare for protecting and securing the property shall be
    12  deducted from the purchase price and that amount shall be an
    13  executively authorized augmentation to the appropriation from
    14  which the costs and fees were paid by the departments, with
    15  priority reimbursements being made to the Department of General
    16  Services and then the Department of Public Welfare.
    17     Section 8 6.  This act shall take effect immediately.          <--
