AN ACT 1 Amending Title 30 (Fish) of the Pennsylvania Consolidated 2 Statutes, providing for the establishment of a new class of 3 regulated lakes. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. The definition of "regulated fishing lake" in 7 section 102 of Title 30 of the Pennsylvania Consolidated 8 Statutes is amended to read: 9 § 102. Definitions. 10 Subject to additional definitions contained in subsequent 11 provisions of this title which are applicable to specific 12 provisions of this title, the following words and phrases when 13 used in this title shall have, unless the context clearly 14 indicates otherwise, the meanings given to them in this section: 15 * * * 16 "Regulated fishing lake." Any artificial or man-made pond or 17 lake owned, leased or controlled in any manner by any person
1 where fishing is permitted for payment of a fee or membership 2 dues and in which all fish stocked are artificially propagated 3 by commercial hatcheries or purchased from persons licensed to 4 sell fish. 5 * * * 6 Section 2. Sections 3102 and 3106 of Title 30 are amended by 7 adding subsections to read: 8 § 3102. Fees. 9 * * * 10 (d) Class C lakes.--The annual license fee for a Class C 11 regulated fishing lake (except portable trout fishing ponds 12 operated as regulated fishing lakes) shall be $10 and shall be 13 based on the total area of the fishing water, which shall not 14 exceed 40 acres, on the premises to be licensed. 15 § 3106. Classification of lakes. 16 * * * 17 (c) Class C.--Lakes that meet all other requirements of this 18 section but are not open to the general public, are not operated 19 as a commercial venture and are owned, leased or operated by a 20 corporation, association, partnership or other entity which 21 limits access to members who pay annual dues and their immediate 22 family may be issued a Class C regulated fishing lake license. 23 Persons patronizing a Class C lake may catch, kill and possess 24 fish taken therefrom without regard to size, season or 25 possession limitation. A fishing license is not required to fish 26 in a Class C lake. 27 Section 3. This act shall take effect immediately. F24L30RZ/19970H1738B2162 - 2 -
