                                     AN ACT

     1  Providing for restrictions on overtime required by employers.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Short title.
     5     This act shall be known and may be cited as the Restricted
     6  Overtime Act.
     7  Section 2.  Definitions.
     8     The following words and phrases when used in this act shall
     9  have the meanings given to them in this section unless the
    10  context clearly indicates otherwise:
    11     "Overtime."  Any period of time that an employee is required
    12  to work in excess of 40 hours within one week.
    13  Section 3.  Right of refusal.
    14     Any employee who is not a party to a collective bargaining
    15  agreement shall have the right to refuse to work in excess of 16
    16  hours' overtime in any week in which he or she has worked 40
    17  hours.

     1  Section 4.  Termination.
     2     An employee who refuses to work in excess of 16 hours'
     3  overtime as described in section 2 shall not be terminated or
     4  otherwise discriminated against on the basis of that refusal.
     5  Section 5.  Effective date.
     6     This act shall take effect immediately.
