                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     causes of action.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8313.  Wrongful discharge action.
     9     (a)  General rule.--A person who, as an employee, is
    10  discharged from employment solely because that person makes a
    11  claim under the act of June 2, 1915 (P.L.736, No.338), known as
    12  the Workers' Compensation Act, shall have a right of action
    13  against the employer for wrongful discharge.
    14     (b)  Definitions.--As used in this section, the following
    15  words and phrases shall have the meanings given to them in this
    16  subsection:


     1     "Employee."  A person who is defined as an "employe" in the
     2  act of June 2, 1915 (P.L.736, No.338), known as the Workers'
     3  Compensation Act.
     4     "Employer."  An employer as defined in the act of June 2,
     5  1915 (P.L.736, No.338), known as the Workers' Compensation Act.
     6     Section 2.  This act shall take effect immediately.
