AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, defining the offenses of aggravated assault by
3 vehicle and aggravated homicide by vehicle.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding sections to read:
8 § 3733.1. Aggravated assault by vehicle.
9 Any person who recklessly causes serious bodily injury to
10 another while violating section 3733 (relating to fleeing or
11 attempting to elude police officer) commits a felony of the
12 second degree. Where there are circumstances manifesting an
13 extreme indifference to the value of human life, such person
14 commits a felony of the first degree.
15 § 3733.2. Aggravated homicide by vehicle.
16 Any person who recklessly causes the death of another person
17 while violating section 3733 (relating to fleeing or attempting
18 to elude police officer) commits a felony in the second degree.
1 Where there are circumstances manifesting malice, such person
2 commits a murder of the third degree.
3 Section 2. This act shall take effect in 60 days.
