AN ACT 1 Amending the act of June 28, 1995 (P.L.89, No.18), entitled "An 2 act creating the Department of Conservation and Natural 3 Resources consisting of certain functions of the Department 4 of Environmental Resources and the Department of Community 5 Affairs; renaming the Department of Environmental Resources 6 as the Department of Environmental Protection; defining the 7 role of the Environmental Quality Board in the Department of 8 Environmental Protection; making changes to responsibilities 9 of the State Conservation Commission and the Department of 10 Agriculture; transferring certain powers and duties to the 11 Department of Health; and repealing inconsistent acts," 12 providing that a portion of revenues from Commonwealth 13 timber, oil and gas sales be distributed to forest districts, 14 school districts and townships in the contiguous area. 15 The General Assembly of the Commonwealth of Pennsylvania 16 hereby enacts as follows: 17 Section 1. Section 302(a) of the act of June 28, 1995 18 (P.L.89, No.18), known as the Conservation and Natural Resources 19 Act, is amended by adding a paragraph to read: 20 Section 302. Forests. 21 (a) Acquisition, establishment and disposition.--The 22 department has the following powers and duties with respect to 23 the acquisition, establishment and disposition of State forest
1 lands and certain other Commonwealth-owned resources: 2 * * * 3 (6.1) To distribute a percent of the net receipts gained 4 from sales of timber, oil, gas or the right to extract 5 timber, oil or gas from lands under direct control of the 6 department, excluding revenues to the Oil and Gas Lease Fund, 7 in the following manner: 8 (i) Six percent to the host school district from 9 which the timber, oil or gas is derived. 10 (ii) Six percent to the host township from which the 11 timber, oil or gas is derived. 12 (iii) Six percent to the forestry district from 13 which the timber, oil or gas is derived. 14 (iv) All distributions shall be used by the 15 appropriate host authority in a manner which benefits the 16 environment or educational system of the host authority. 17 * * * 18 Section 2.
