AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for licenses. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 6109(e)(3) and (h) of Title 18 of the 6 Pennsylvania Consolidated Statutes are amended to read: 7 § 6109. Licenses. 8 * * * 9 (e) Issuance of license.-- 10 * * * 11 (3) The license shall bear the name, address, date of 12 birth, race, sex, citizenship, Social Security number, 13 height, weight, color of hair, color of eyes and signature of 14 the licensee; the signature of the sheriff issuing the 15 license; the reason for issuance; and the period of 16 validation. The sheriff [may] shall also require a photograph 17 of the licensee on the license. The photograph requirement
1 shall be waived if the licensee's religious beliefs forbid or 2 discourage the taking of photographs of the licensee. The 3 original license shall be issued to the applicant. The first 4 copy of the license shall be forwarded to the commissioner 5 within seven days of the date of issue, and a second copy 6 shall be retained by the issuing authority for a period of 7 six years. 8 * * * 9 (h) Fee.--The fee for a license to carry a firearm is $19. 10 This includes a renewal notice processing fee of $1.50. This 11 includes an administrative fee of $5 under section 14(2) of the 12 act of July 6, 1984 (P.L.614, No.127), known as the Sheriff Fee 13 Act. The sheriff may charge an applicant an additional fee not 14 to exceed actual costs, or $5, whichever is less, to cover the 15 costs of complying with the photograph requirement under 16 subsection (e)(3). No fee other than that provided by this 17 paragraph or the Sheriff Fee Act may be assessed by the sheriff 18 for the performance of any background check made pursuant to 19 this act. The fee is payable to the sheriff to whom the 20 application is submitted and is payable at the time of 21 application for the license. Except for the administrative fee 22 of $5 under section 14(2) of the Sheriff Fee Act, all other fees 23 shall be refunded if the application is denied but shall not be 24 refunded if a license is issued and subsequently revoked. A 25 person who sells or attempts to sell a license to carry a 26 firearm for a fee in excess of the amounts fixed under this 27 subsection commits a summary offense. 28 * * * 29 Section 2.
