                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the license to
     3     carry firearms.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6109(e)(3) and (h) of Title 18 of the
     7  Pennsylvania Consolidated Statutes are amended and subsection
     8  (e) is amended by adding a paragraph to read:
     9  § 6109.  Licenses.

    11     (e)  Issuance of license.--
    12         * * *
    13         (3)  The license shall bear the name, address, date of
    14     birth, race, sex, citizenship, Social Security number,
    15     height, weight, color of hair, color of eyes and signature of
    16     the licensee; the signature of the sheriff issuing the
    17     license; the reason for issuance; [and] the period of
    18     validation; and an identification number. The sheriff [may]

     1     shall also require a photograph of the licensee on the
     2     license. The original license shall be issued to the
     3     applicant. The first copy of the license shall be forwarded
     4     to the commissioner within seven days of the date of issue,
     5     and a second copy shall be retained by the issuing authority
     6     for a period of six years.
     7         (4)  There shall be only one permit issued to the
     8     applicant for each firearm the applicant may wish to carry.
     9     The license shall bear the serial number of each particular
    10     firearm. There shall be no waiting period for subsequent
    11     licenses beyond the first license.

    13     (h)  Fee.--
    14         (1)  The fee for a license to carry a firearm is [$19]
    15     $32. This includes a renewal notice processing fee of $1.50.
    16     This includes an administrative fee of $5 under section 14(2)
    17     of the act of July 6, 1984 (P.L.614, No.127), known as the
    18     Sheriff Fee Act. No fee other than that provided by this
    19     paragraph or the Sheriff Fee Act may be assessed by the
    20     sheriff for the performance of any background check made
    21     pursuant to this act. The fee is payable to the sheriff to
    22     whom the application is submitted and is payable at the time
    23     of application for the license. Except for the administrative
    24     fee of $5 under section 14(2) of the Sheriff Fee Act, all
    25     other fees shall be refunded if the application is denied but
    26     shall not be refunded if a license is issued and subsequently
    27     revoked. A person who sells or attempts to sell a license to
    28     carry a firearm for a fee in excess of the amounts fixed
    29     under this subsection commits a summary offense.
    30         (2)  Of the $32 fee collected under paragraph (1), $13

     1     shall be used by the county for anti-violence initiatives.
     2     Each county shall establish a separate fund to receive this
     3     fee and from which disbursements shall be made for the
     4     purpose described in this paragraph.

     6     Section 2.  All acts and parts of acts are repealed insofar
     7  as they are inconsistent with this act.
     8     Section 3.  This act shall take effect in 60 days.
