        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MARCH 11, 1997

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting the furnishing of drug-
     3     free urine for the purpose of evading drug tests.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7509.  Furnishing drug-free urine.
     9     (A)  UNLAWFUL SALE OR ATTEMPT.--A person commits a             <--
    10  misdemeanor of the third degree if he offers for sale, sells,
    11  causes to be sold or gives drug-free urine for the purpose of or
    12  which is used for evading or causing deceitful results in a test
    13  for the presence of drugs.
    14     (B)  USE OR ATTEMPT.--A PERSON COMMITS A MISDEMEANOR OF THE    <--
    15  THIRD DEGREE IF HE USES OR ATTEMPTS TO USE DRUG-FREE URINE AS


     1  PROVIDED IN SUBSECTION (A) FOR THE PURPOSE OF EVADING OR CAUSING
     2  DECEITFUL RESULTS IN A TEST FOR THE PRESENCE OF DRUGS.
     3     Section 2.  This act shall take effect in 60 days.
