AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," prohibiting restrictions by the
6 Department of Education on certain reimbursement.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2574 of the act of March 10, 1949
10 (P.L.30, No.14), known as the Public School Code of 1949, is
11 amended by adding a subsection to read:
12 Section 2574. Approved Reimbursable Rental for Leases
13 Hereafter Approved and Approved Reimbursable Sinking Fund
14 Charges on Indebtedness.--* * *
15 (c.3) The Department of Education shall not promulgate any
16 rules, regulations or standards which restrict reimbursement
17 under subsection (c) on the basis of the age of the building,
18 the elapsed period of time subsequent to any previous
19 reimbursable project or the replacement value of a facility as
1 computed in relation to the full-time equivalent capacity of
2 elementary and secondary school buildings and the cost of new
3 construction as determined by the Department of Education.
