AN ACT
1 Prohibiting negative option billing for renewal of maintenance
2 service contracts.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Renewal of maintenance service contract.
6 (a) General rule.--A provider of maintenance services may
7 not bill a consumer for renewal of a service contract that a
8 consumer has not affirmatively ordered by request. A consumer's
9 failure to reject an offered renewal is not an affirmative
10 order.
11 (b) Method of renewal.--A consumer's affirmative order for
12 renewal may be made electronically or in writing.
13 (c) Definition.--As used in this section, the term "service
14 contract" means a maintenance agreement covering services to
15 maintain and repair a product purchased by a consumer for an
16 agreed period of time.
17 Section 2. Effective date.
1 This act shall take effect immediately.
