HOUSE RESOLUTION

        INTRODUCED BY WALKO, TANGRETTI, MELIO, MANDERINO, SURRA, STURLA,
           TRAVAGLIO, SCRIMENTI, STETLER, MUNDY, TRICH, VEON, WOZNIAK,
           M. COHEN, ITKIN, DeWEESE, JOSEPHS, GIGLIOTTI AND SAINATO,
           OCTOBER 31, 1995

        REFERRED TO COMMITTEE ON RULES, OCTOBER 31, 1995

                                  A RESOLUTION

     1  Directing the Local Government Commission to conduct a study of
     2     municipal pooling to purchase certain kinds of insurance.

     3     WHEREAS, The General Assembly has encouraged municipalities
     4  to cooperate with other governmental units in the exercise or
     5  performance of their functions, powers or responsibilities under
     6  the provisions of the Intergovernmental Cooperation Law; and
     7     WHEREAS, The General Assembly has encouraged local agencies
     8  to join together for the purpose of purchasing public liability
     9  insurance under the provisions of section 221(1) of the JARA
    10  Continuation Act of 1980; and
    11     WHEREAS, The General Assembly has encouraged homogeneous
    12  employers to join together for the purchase of workers'
    13  compensation insurance under the provisions of Articles VII
    14  through XIII of the Workers' Compensation Act; and
    15     WHEREAS, Certain municipalities may be joining together to
    16  purchase health and hospitalization or other kinds of insurance
    17  for their employees and operations under the provisions of the

     1  Intergovernmental Cooperation Law; and
     2     WHEREAS, Various local government associations are assisting
     3  their member municipalities to pool together to purchase group
     4  insurance; and
     5     WHEREAS, The House of Representatives believes that the cost
     6  of operations and employing personnel by municipalities may be
     7  reduced if more municipalities would enter into agreements to
     8  form regional or Statewide pools to purchase various kinds of
     9  insurance; and
    10     WHEREAS, The reduced cost of insurance could provide
    11  municipalities with additional funds to purchase equipment and
    12  improve facilities so that municipal services could be enhanced;
    13  therefore be it
    14     RESOLVED, That the House of Representatives direct the Local
    15  Government Commission to undertake a study to determine the
    16  extent to which municipalities are pooling together to purchase
    17  liability, workers' compensation, health and hospitalization and
    18  other kinds of insurance, the cost savings realized by this
    19  pooling and ways to encourage more municipalities to enter into
    20  regional or Statewide pools for the purchase of various kinds of
    21  insurance; and be it further
    22     RESOLVED, That to accomplish this goal, the Local Government
    23  Commission may hold hearings, take testimony and make its
    24  investigations at such places as it deems necessary in this
    25  Commonwealth. Each member of the commission shall have power to
    26  administer oaths and affirmations to witnesses appearing before
    27  the commission; and be it further
    28     RESOLVED, That the commission prepare a report containing its
    29  findings, and, if appropriate, propose necessary legislation,
    30  and deliver such report to the House of Representatives as soon
