                                     AN ACT

     1  Amending the act of December 29, 1972 (P.L.1713, No.367),
     2     entitled "An act concerning motor vehicle physical damage
     3     appraisers; providing for the licensing of persons engaged in
     4     appraising physical damages to motor vehicles; fixing fees
     5     and prescribing unlawful acts and penalties," further
     6     providing for penalties; and providing for administration and
     7     enforcement by the Insurance Commissioner and the Attorney
     8     General.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Sections 9 and 10 of the act of December 29, 1972
    12  (P.L.1713, No.367), known as the Motor Vehicle Physical Damage
    13  Appraiser Act, are amended to read:
    14     Section 9.  Penalties.--Any person who violates any of the
    15  provisions of this act is guilty of a misdemeanor and upon
    16  conviction thereof, for each offense, shall be sentenced to pay
    17  a fine not exceeding [five hundred dollars ($500)] five thousand
    18  dollars ($5000), or to undergo imprisonment not exceeding one
    19  year, or both.
    20     Section 10.  Rules and Regulations.--The Insurance


     1  Commissioner is hereby charged with the administration and
     2  enforcement of sections 1 through 8 of this act and shall
     3  prescribe, adopt and promulgate rules and regulations in
     4  connection therewith.
     5     Section 2.  The act is amended by adding a section to read:
     6     Section 11.1.  Powers and Duties of Attorney General.--The
     7  Attorney General shall be charged with the administration and
     8  enforcement of section 11 of this act and shall prescribe, adopt
     9  and promulgate rules and regulations in connection therewith.
    10     Section 3.  This act shall take effect in 60 days.
