AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for fleeing or attempting to
3 elude police officer.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3733 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 3733. Fleeing or attempting to elude police officer.

10 (d) Unmarked cars.--While driving a vehicle which is not
11 clearly identifiable by its markings as a police vehicle, a
12 police officer may not attempt to stop a moving vehicle unless
13 the driver or an occupant of the vehicle is suspected of having
14 violated one of the following:
15 Section 3367 (relating to racing on highways).
16 Section 3731 (relating to driving under influence of
17 alcohol or controlled substance).
18 Section 3732 (relating to homicide by vehicle).
1 Section 3733 (relating to fleeing or attempting to elude
2 police officer).
3 Section 3734 (relating to driving without lights to avoid
4 identification or arrest).
5 Section 3735 (relating to homicide by vehicle while
6 driving under influence).
7 Section 3736 (relating to reckless driving).
8 Section 3742 (relating to accidents involving death or
9 personal injury).
10 Section 3743 (relating to accidents involving damage to
11 attended vehicle or property).
12 Section 2. This act shall take effect in 60 days.
