AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing for the discontinuance of 6 programs and courses not fully funded by the Commonwealth. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 10 as the Public School Code of 1949, is amended by adding a 11 section to read: 12 Section 2597. Discontinuance of Programs and Courses Not 13 Fully Funded by the Commonwealth.--The Department of Education 14 shall undertake on or before July 1 of each year an annual 15 review of all programs and courses required by the Commonwealth 16 to be provided by school districts. The Department of Education 17 shall determine for each program or course whether the 18 Commonwealth provides full reimbursement to school districts for 19 the cost of providing each required program or course. The
1 results of the review shall be published in the Pennsylvania 2 Bulletin. Notwithstanding any other provisions of law, if the 3 Commonwealth does not provide for full reimbursement for the 4 cost of a program or course, a school district shall not be 5 required to provide the program or course during the ensuing 6 school year. 7 (b) Subsection (a) shall not apply to programs and courses 8 that are necessary for the operation of a thorough and efficient 9 system of public education provided for in Article III, section 10 14 of the Constitution of Pennsylvania or to programs or courses 11 required for eligibility for Federal assistance. 12 Section 2. All acts and parts of acts are repealed insofar 13 as they are inconsistent with this act. 14 Section 3. This act shall take effect in 60 days. B6L24WMB/19960H2612B3530 - 2 -
