                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for possession of
     3     weapon on school property.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 912 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding subsections to read:
     8  § 912.  Possession of weapon on school property.
     9     * * *
    10     (b.1)  Suspension.--Whenever an individual violates this
    11  section, the court shall order the operating privilege of the
    12  person suspended.
    13     (b.2)  Duration of suspension.--When the Department of
    14  Transportation suspends the operating privilege of a person
    15  under subsection (b.1), the duration of the suspension shall be
    16  as follows:
    17         (1)  For a first offense, a period of one year.


     1         (2)  For a second offense, and any offense thereafter, a
     2     period of two years.
     3     (b.3)  Nondrivers.--Any person whose record is received by
     4  the Department of Transportation under subsection (b.1) and who
     5  does not have a driver's license shall be ineligible to apply
     6  for a learner's permit under 75 Pa.C.S. §§ 1505 (relating to
     7  learners' permits) and 1507 (relating to application for
     8  driver's license or learner's permit by minor) for the time
     9  periods specified in subsection (b.2). If the person is under 16
    10  years of age when he is convicted or adjudicated delinquent or
    11  admitted to a preadjudication program, his suspension of
    12  operating privileges shall commence upon his 16th birthday for
    13  the time periods specified in subsection (b.2).
