                                     AN ACT

     1  Transferring provisions to the Department of Conservation and
     2     Natural Resources.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Transfer provisions.
     6     The following are transferred to the Department of
     7  Conservation and Natural Resources:
     8         (1)  The Bureau of Abandoned Mine Reclamation.
     9         (2)  All personnel, allocations, appropriations,
    10     equipment, files, records, contracts, agreements, obligations
    11     and other materials which are used, employed or expended by
    12     the Department of Environmental Resources in connection with
    13     the functions transferred by this act to the Department of
    14     Conservation and Natural Resources in the first instance and
    15     as if these contracts, agreements and obligations had been
    16     incurred or entered into by the Department of Conservation


     1     and Natural Resources.
     2  Section 2.  Apportionment.
     3     The personnel, appropriations, equipment and other items and
     4  material transferred by this section shall include an
     5  appropriate portion of the general administrative, overhead and
     6  supporting personnel, appropriations, equipment and other
     7  material of the agency and shall also include, where applicable,
     8  Federal grants and funds and other benefits from any Federal
     9  program.
    10  Section 3.  Status of employees.
    11     All personnel transferred pursuant to this act shall retain
    12  any civil service employment status assigned to the personnel.
    13  Section 4.  Civil service status.
    14     All positions in the Department of Conservation and Natural
    15  Resources shall be deemed to be included in the list of
    16  positions set forth in section 3(d) of the act of August 5, 1941
    17  (P.L.752, No.286), known as the Civil Service Act, and the
    18  provisions and benefits of that act shall apply to the employees
    19  of and positions in the Department of Conservation and Natural
    20  Resources.
    21  Section 2.  Effective date.
    22     This act shall take effect in 60 days.
