                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for penalties and
     3     definitions relating to terroristic threats.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2706 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2706.  Terroristic threats.
     9     [A person is guilty of a misdemeanor of the first degree if
    10  he threatens to commit any crime of violence with intent to
    11  terrorize another or to cause evacuation of a building, place of
    12  assembly, or facility of public transportation, or otherwise to
    13  cause serious public inconvenience, or in reckless disregard of
    14  the risk of causing such terror or inconvenience.]
    15     (a)  Terroristic threats against an individual.--A person
    16  commits terroristic threats against an individual if he
    17  threatens to commit any crime of violence with the intent to
    18  terrorize another.

     1     (b)  Terroristic threats against a group of persons.--A
     2  person commits terroristic threats against a group of persons if
     3  he threatens to commit any crime of violence, including, but not
     4  limited to, bomb threats with the intent to terrorize others or
     5  to cause the evacuation of a building, place of assembly or
     6  facility of public transportation, or to disrupt the operation
     7  of a place of business or to otherwise cause serious public
     8  inconvenience or in reckless disregard of the risk of causing
     9  such terror or inconvenience.
    10     (c)  Penalties.--
    11         (1)  A person who violates subsection (a) commits a
    12     misdemeanor of the first degree.
    13         (2)  A person who violates subsection (b) commits a
    14     felony of the third degree.
    15         (3)  The sentencing court shall require a person who
    16     violates this section to make restitution for any costs
    17     incurred by the threatened party or by any emergency agency
    18     responding to the report.
    19     (d)  Definitions.--As used in this section, the following
    20  words and phrases shall have the meanings given to them in this
    21  subsection:
    22     "Bomb."  A device capable of producing damage to material and
    23  injury or death to people through fragmentation, heat and blast
    24  waves or through the production of incendiary heat when the
    25  device is detonated or ignited.
    26     "Bomb threat."  A message delivered by any means warning or
    27  claiming the presence of one or more bombs, possibly but not
    28  necessarily including the location and possible detonation time
    29  of the bomb, or an ultimatum relating to the detonation,
    30  ignition or concealment of the bomb.

     1     "Crime of violence."  Criminal acts including, but not
     2  limited to, murder, rape, aggravated assault, robbery, burglary,
     3  entering a building with the intent to commit a crime therein,
     4  bombing and kidnapping.
     5     Section 2.  This act shall take effect in 60 days.
