                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for criminal trespass in
     3     school buildings.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3503(a) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3503.  Criminal trespass.
     9     (a)  Buildings and occupied structures.--
    10         (1)  A person commits an offense if, knowing that he is
    11     not licensed or privileged to do so, he:
    12             (i)  enters, gains entry by subterfuge or
    13         surreptitiously remains in any building or occupied
    14         structure or separately secured or occupied portion
    15         thereof; [or]
    16             (ii)  breaks into any building or occupied structure
    17         or separately secured or occupied portion thereof[.]; or
    18             (iii)  enters and remains without approval from an

     1         authorized school official in any public or private
     2         school building during school hours or after normal
     3         school hours.
     4         (2)  An offense under paragraph (1)(i) is a felony of the
     5     third degree[, and an]. An offense under paragraph (1)(ii) is
     6     a felony of the second degree. An offense under paragraph
     7     (1)(iii) is a misdemeanor of the third degree.
     8         (3)  As used in this subsection:
     9             "Breaks into."  To gain entry by force, breaking,
    10         intimidation, unauthorized opening of locks, or through
    11         an opening not designed for human access.
