        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           APRIL 24, 1995

                                     AN ACT

     1  Amending the act of May 27, 1953 (P.L.244, No.34), entitled "An
     2     act relating to and regulating the contracts of incorporated
     3     towns and providing penalties," further providing for
     4     contracts.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2(d)(2) of the act of May 27, 1953
     8  (P.L.244, No.34), entitled "An act relating to and regulating
     9  the contracts of incorporated towns and providing penalties,"
    10  amended July 10, 1990 (P.L.392, No.93), is amended AND THE        <--
    11  SUBSECTION IS AMENDED BY ADDING A CLAUSE to read:
    12     Section 2.  Regulation of Contracts.--* * *
    13     (d)  The contracts or purchases made by council [involving an
    14  expenditure of over ten thousand dollars], which shall not
    15  require advertising [or], bidding or price quotations as
    16  hereinbefore provided, are as follows:
    17     * * *
    18     (2)  Those made for improvements, repairs and maintenance of


     1  any kind made or provided by any incorporated town through its
     2  own employes: Provided, That all materials used for street
     3  improvement, maintenance and/or construction in excess of [ten
     4  thousand dollars] four thousand dollars be subject to the
     5  relevant price quotation or advertising requirements contained
     6  herein.

     8     (3.1)  THOSE FOR USED EQUIPMENT, ARTICLES, APPARATUS,          <--
     9  APPLIANCES, VEHICLES OR PARTS THEREOF BEING PURCHASED FROM A
    10  PUBLIC UTILITY.

    12     Section 2.  Section 3.1(a) of the act is repealed.
    13     Section 3.  This act shall take effect in 60 days.
