                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the temporary suspension of
     3     financial responsibility under certain conditions.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1711 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1711.  Required benefits.
     9     (a)  Medical benefit.--An insurer issuing or delivering
    10  liability insurance policies covering any motor vehicle of the
    11  type required to be registered under this title, except
    12  recreational vehicles not intended for highway use, motorcycles,
    13  motor-driven cycles or motorized pedalcycles or like type
    14  vehicles, registered and operated in this Commonwealth, shall
    15  include coverage providing a medical benefit in the amount of
    16  $5,000.

     1     (b)  Minimum policy.--All insurers subject to this chapter
     2  shall make available for purchase a motor vehicle insurance
     3  policy which contains only the minimum requirements of financial
     4  responsibility and medical benefits as provided for in this
     5  chapter.
     6     (c)  Temporary suspension of financial responsibility.--
     7         (1)  Any insurer issuing or delivering an insurance
     8     policy for a motor vehicle subject to the provisions of this
     9     chapter may, at the written request of the owner of that
    10     motor vehicle who complies with paragraph (2), temporarily
    11     suspend financial responsibility for a period of 30 days or
    12     more.
    13         (2)  An owner who desires to obtain a temporary
    14     suspension of financial responsibility shall:
    15             (i)  Present a written request to the insurer
    16         requesting a temporary suspension of financial
    17         responsibility.
    18             (ii)  Certify to the insurer that the motor vehicle
    19         which is covered will be out of use for at least 30
    20         consecutive days.
    21             (iii)  Certify that the owner will not operate the
    22         motor vehicle during the period of the temporary
    23         suspension.
    24             (iv)  Surrender the registration plate of the motor
    25         vehicle to the insurer.
    26         (3)  Any insurer who grants a temporary suspension of
    27     financial responsibility under this subsection shall provide
    28     for a reduced premium or a refund of any premium paid, which
    29     refund is equivalent to the value of the premium during the
    30     period of temporary suspension.

     1         (4)  The commissioner shall promulgate rules and
     2     regulations to govern the suspension provision of this
     3     subsection.
     4     Section 2.  This act shall take effect in 60 days.
