                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," further providing for the    <--
    21     repair, renovation and maintenance of the Capitol Building
    22     and the Capitol Annex Building; and providing for additional
    23     duties of the Department of Corrections AND COUNTIES in        <--
    24     relation to prison inmate medical needs AND FOR SEASONAL FARM  <--
    25     LABOR; AND MAKING REPEALS.

    26     The General Assembly of the Commonwealth of Pennsylvania


     1  hereby enacts as follows:
     2     Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
     3  as The Administrative Code of 1929, is amended by adding a
     4  section to read:
     5     Section 903-B.  Payment of Inmate Medical Needs.--(a)  The
     6  Department of Corrections shall devise and implement a program
     7  whereby inmates of State and county correctional institutions     <--
     8  who have medical insurance shall pay for their own medical needs
     9  through that insurance.
    10     (b)  This program shall be contained in regulations
    11  promulgated by the department.
    12     (C)  EACH COUNTY MAY DEVISE AND IMPLEMENT A PROGRAM WHEREBY    <--
    13  INMATES OF COUNTY CORRECTIONAL INSTITUTIONS WHO HAVE MEDICAL
    14  INSURANCE SHALL PAY FOR THEIR OWN MEDICAL NEEDS THROUGH THAT
    15  INSURANCE.
    16     Section 2.  Section 2402.1 of the act is amended by adding
    17  subsections to read:
    18     Section 2402.1.  Utilization of Capitol Annex.--* * *
    19     (e)  In order to best preserve the architectural and
    20  historical integrity of the State Capitol Building and Capitol
    21  Annex Building and to expedite the completion of projects
    22  pertaining to those buildings, the Capitol Preservation
    23  Committee may by resolution assume full responsibility and
    24  authority for the repair, renovation and maintenance of the
    25  State Capitol Building and Capitol Annex Building, including
    26  contract selection and the supervision and implementation of
    27  projects relating to those buildings.
    28     (f)  The Capitol Preservation Committee may dispense with any
    29  requirement of this act, the act of May 1, 1913 (P.L.155,
    30  No.104), entitled "An act regulating the letting of certain

     1  contracts for the erection, construction, and alteration of
     2  public buildings," and the act of November 26, 1978 (P.L.1309,
     3  No.317), referred to as the Public Works Contract Regulation
     4  Law, relating to contract selection and procedure and
     5  supervision with respect to projects for the restoration,
     6  preservation, adaptive reuse, renovation and repair of the State
     7  Capitol Building and the Capitol Annex Building. The Capitol
     8  Preservation Committee may only exercise the powers granted by
     9  this subsection if it adopts the resolution provided for in
    10  subsection (e) or is a party to any agreement authorized under
    11  subsection (g).
    12     (g)  The Capitol Preservation Committee and the Department of
    13  General Services may enter into agreements in regard to the
    14  delegation of some or all of the powers and duties to plan,
    15  design, contract, administer and manage any project relating to
    16  the State Capitol Building or the Capitol Annex Building and the
    17  furnishing and equipping thereof subject to such reasonable,
    18  necessary and appropriate conditions as may be mutually agreed
    19  upon between the Capitol Preservation Committee and the
    20  Department of General Services.
    21     (h)  Notwithstanding any provision in this section to the
    22  contrary, all work on the State Capitol Building and the Capitol
    23  Annex Building shall require prior approval of the Capitol
    24  Preservation Committee.
    25     SECTION 2.  THE ACT IS AMENDED BY ADDING A SECTION TO READ:    <--
    26     SECTION 1714.  SEASONAL FARM LABOR.--(A)  THE DEPARTMENT OF
    27  AGRICULTURE SHALL HAVE THE POWER, AND ITS DUTIES SHALL BE:
    28     (1)  TO EXERCISE THE POWERS AND DUTIES AND PERFORM THE DUTIES
    29  BY LAW HERETOFORE VESTED IN AND IMPOSED UPON THE DEPARTMENT OF
    30  ENVIRONMENTAL RESOURCES UNDER THE ACT OF JUNE 23, 1978 (P.L.537,

     1  NO.93), KNOWN AS THE "SEASONAL FARM LABOR ACT."
     2     (2)  TO EXERCISE THE POWERS AND PERFORM THE DUTIES AUTHORIZED
     3  OR IMPOSED UPON THE ENVIRONMENTAL HEARING BOARD IN THE "SEASONAL
     4  FARM LABOR ACT."
     5     (3)  TO ENFORCE THE PROVISIONS OF 25 PA. CODE CH. 177
     6  (RELATING TO SEASONAL FARM LABOR CAMPS) WITH THE SAME FORCE AND
     7  EFFECT AS THOUGH THE REGULATIONS WERE PROMULGATED BY THE
     8  DEPARTMENT OF AGRICULTURE UNDER THE "SEASONAL FARM LABOR ACT."
     9     (B)  THE SECRETARY OF AGRICULTURE SHALL HAVE THE POWER, AND
    10  THE SECRETARY'S DUTY SHALL BE:
    11     (1)  TO EXERCISE THE POWERS AND PERFORM THE DUTIES IMPOSED
    12  UPON THE SECRETARY OF ENVIRONMENTAL RESOURCES IN CHAPTER 3 OF
    13  THE "SEASONAL FARM LABOR ACT."
    14     (2)  TO EXERCISE THE POWERS AND DUTIES VESTED BY LAW AND
    15  IMPOSED UPON THE ENVIRONMENTAL QUALITY BOARD AS SPECIFICALLY SET
    16  FORTH IN THE "SEASONAL FARM LABOR ACT."
    17     SECTION 3.  (A)  SECTION 502(C) OF THE ACT OF JUNE 28, 1995
    18  (P.L.89, NO.18), KNOWN AS THE CONSERVATION AND NATURAL RESOURCES
    19  ACT, IS REPEALED TO THE EXTENT THAT IT IS INCONSISTENT WITH THIS
    20  ACT.
    21     (B)  SECTION 506 OF THE CONSERVATION AND NATURAL RESOURCES
    22  ACT IS REPEALED.
    23     Section 3 2 4.  This act shall take effect immediately.        <--
