AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for the <-- 21 repair, renovation and maintenance of the Capitol Building 22 and the Capitol Annex Building; and providing for additional 23 duties of the Department of Corrections AND COUNTIES in <-- 24 relation to prison inmate medical needs. 25 The General Assembly of the Commonwealth of Pennsylvania 26 hereby enacts as follows:
1 Section 1. The act of April 9, 1929 (P.L.177, No.175), known 2 as The Administrative Code of 1929, is amended by adding a 3 section to read: 4 Section 903-B. Payment of Inmate Medical Needs.--(a) The 5 Department of Corrections shall devise and implement a program 6 whereby inmates of State and county correctional institutions <-- 7 who have medical insurance shall pay for their own medical needs 8 through that insurance. 9 (b) This program shall be contained in regulations 10 promulgated by the department. 11 (C) EACH COUNTY MAY DEVISE AND IMPLEMENT A PROGRAM WHEREBY <-- 12 INMATES OF COUNTY CORRECTIONAL INSTITUTIONS WHO HAVE MEDICAL 13 INSURANCE SHALL PAY FOR THEIR OWN MEDICAL NEEDS THROUGH THAT 14 INSURANCE. 15 Section 2. Section 2402.1 of the act is amended by adding <-- 16 subsections to read: 17 Section 2402.1. Utilization of Capitol Annex.--* * * 18 (e) In order to best preserve the architectural and 19 historical integrity of the State Capitol Building and Capitol 20 Annex Building and to expedite the completion of projects 21 pertaining to those buildings, the Capitol Preservation 22 Committee may by resolution assume full responsibility and 23 authority for the repair, renovation and maintenance of the 24 State Capitol Building and Capitol Annex Building, including 25 contract selection and the supervision and implementation of 26 projects relating to those buildings. 27 (f) The Capitol Preservation Committee may dispense with any 28 requirement of this act, the act of May 1, 1913 (P.L.155, 29 No.104), entitled "An act regulating the letting of certain 30 contracts for the erection, construction, and alteration of 19950H0406B2567 - 2 -
1 public buildings," and the act of November 26, 1978 (P.L.1309, 2 No.317), referred to as the Public Works Contract Regulation 3 Law, relating to contract selection and procedure and 4 supervision with respect to projects for the restoration, 5 preservation, adaptive reuse, renovation and repair of the State 6 Capitol Building and the Capitol Annex Building. The Capitol 7 Preservation Committee may only exercise the powers granted by 8 this subsection if it adopts the resolution provided for in 9 subsection (e) or is a party to any agreement authorized under 10 subsection (g). 11 (g) The Capitol Preservation Committee and the Department of 12 General Services may enter into agreements in regard to the 13 delegation of some or all of the powers and duties to plan, 14 design, contract, administer and manage any project relating to 15 the State Capitol Building or the Capitol Annex Building and the 16 furnishing and equipping thereof subject to such reasonable, 17 necessary and appropriate conditions as may be mutually agreed 18 upon between the Capitol Preservation Committee and the 19 Department of General Services. 20 (h) Notwithstanding any provision in this section to the 21 contrary, all work on the State Capitol Building and the Capitol 22 Annex Building shall require prior approval of the Capitol 23 Preservation Committee. 24 Section 3 2.
