                                     AN ACT

     1  Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
     2     act providing for safe drinking water; imposing powers and
     3     duties on the Department of Environmental Resources in
     4     relation thereto; and appropriating certain funds," further
     5     providing for testing by the Department of Environmental
     6     Resources.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Sections 8 and 9 of the act of May 1, 1984
    10  (P.L.206, No.43), known as the Pennsylvania Safe Drinking Water
    11  Act, are amended to read:
    12  Section 8.  Inspections and recordkeeping requirements.
    13     (a)  Department authorized to inspect, test, etc.--The
    14  department is authorized to make inspections and conduct tests
    15  or sampling, including the examination and copying of books,
    16  papers, records and data, pertinent to any matter under
    17  investigation in order to determine compliance with this act and
    18  for this purpose, the duly authorized agents and employees of


     1  the department are authorized at all reasonable times to enter
     2  and examine any property, facility, operation or activity.
     3     (b)  Department authorized to establish recordkeeping
     4  requirements.--The department and its agents are authorized to
     5  require any supplier of water to establish and maintain such
     6  records and make such reports and furnish such information as
     7  the department may prescribe as being necessary to demonstrate
     8  that the supplier is complying with the requirements of this act
     9  and with the terms and conditions of its water supply permit.
    10     (c)  Required testing.--The department shall require, not
    11  less than once a month, all public water suppliers to conduct
    12  giardiasis tests of each water source which supplies water for
    13  public consumption, unless a more frequent testing schedule is
    14  determined to be necessary by the department. If any test
    15  indicates positive results, the department shall require weekly
    16  testing of the water source for a period not exceeding three
    17  months.
    18  Section 9.  Laboratories.
    19     (a)  Department to establish standards of performance.--The
    20  department shall establish standards of performance, by rule or
    21  regulation, for laboratories and laboratory officers which
    22  conduct analytical measurements for the purpose of ascertaining
    23  compliance by public water systems, including bottled and bulk
    24  water operations, with the requirements of this act.
    25     (b)  Items to be included in standards.--Such standards may
    26  include, but are not limited to, equipment, laboratory
    27  procedures, standards for analytical methods, quality control,
    28  staffing, records, reports and any other matters that may affect
    29  the quality and reliability of laboratory performance.
    30     (c)  Laboratories to be inspected.--The department shall

     1  periodically inspect and certify laboratories and laboratory
     2  offices that meet the standards established under subsection
     3  (a).
     4     (d)  Notification.--In any case where the tests required by
     5  section 8(c) indicate positive results, the testing laboratory
     6  shall notify the public water supplier from which the sample was
     7  obtained of the results within one hour after the test results
     8  are confirmed.
     9     Section 2.  This act shall take effect in 60 days.
