           JANUARY 26, 1995

REFERRED TO COMMITTEE ON INTERGOVERNMENTAL AFFAIRS,
           JANUARY 26, 1995

                                     AN ACT

     1  Providing for the review and coordination of Federal mandates;
2 and establishing the Joint Legislative Committee on Federal
     3 Mandates.

4 The General Assembly of the Commonwealth of Pennsylvania
     5 hereby enacts as follows:
     6 Section 1. Short title.
7 This act shall be known and may be cited as the Joint
8 Legislative Committee on Federal Mandates Act.
9 Section 2. Legislative findings and declarations.
10 The General Assembly finds and declares that:
11 (1) The Tenth Amendment to the Constitution of the
12 United States reads as follows: "The powers not delegated to
13 the United States by the Constitution, nor prohibited by it
14 to the States, are reserved to the States respectively, or to
    15 the people."

1 (2) The number of Federal mandates imposed upon the
2 states by the Congress of the United States has increased
     3 alarmingly in recent years.
4 (3) The General Assembly desires to personally protect
5 the sovereignty of this Commonwealth from Federal
6 encroachment as well as communicate with the members of
7 Congress from Pennsylvania concerning this critical problem
8 so that these representatives may be completely cognizant of
9 the effect the actions of the Federal Government have at the
10 legislative level and may be more sensitive to Federal
11 usurpation of the authority of the Commonwealth.
12 (4) Nothing in this act shall be construed to authorize
13 the Joint Legislative Committee on Federal Mandates to
14 exercise the legislative power vested in the General Assembly
15 by section 1 of Article II of the Constitution of
