                                     AN ACT

     1  Amending the act of July 1, 1981 (P.L.193, No.58), entitled, as
     2     amended, "An act establishing certain fees to be charged by
     3     clerks of the orphans' courts of counties of the fifth,
     4     sixth, seventh and eighth class and providing for fees in
     5     counties of the second through eighth class," providing for
     6     the establishment and modification of fees; and providing for
     7     the imposition of an additional fee.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2.1 of the act of July 1, 1981 (P.L.193,
    11  No.58), referred to as the Clerk of Orphans' Court Fee Law,
    12  added July 10, 1990 (P.L.372, No.85), is amended to read:
    13     Section 2.1.  In counties of the second, second A, third,
    14  fourth, fifth, sixth, seventh and eighth class on or after the
    15  effective date of this act, the Clerk of the Orphans' Court may
    16  establish, increase, decrease, modify or eliminate fees and
    17  charges with the approval of the President Judge [within 60 days
    18  of the effective date of this section]. Thereafter, such fees
    19  and charges shall [not] be established, increased, decreased,
    20  modified or eliminated [except by an act of the General

     1  Assembly] as determined by the Clerk of the Orphans' Court and
     2  the President Judge.
     3     Section 2.  The act is amended by adding a section to read:
     4     Section 2.2.  An additional fee may be charged and collected
     5  by the Clerk of the Orphans' Court of a county of the second
     6  class for the initiation of any action or legal proceeding. The
     7  additional fee shall be deposited into a special Clerk of the
     8  Orphans' Court computer fund established in each county of the
     9  second class. Moneys in the special fund shall be used by the
    10  Clerk of the Orphans' Court, with the approval of the President
    11  Judge, solely for the purposes of computerization and document
    12  reproduction in the office of the Clerk of the Orphans' Court.
    13     Section 3.  This act shall take effect in 30 days.
