AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," authorizing residency requirements
6 under certain circumstances.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 1106 of the act of March 10, 1949
10 (P.L.30, No.14), known as the Public School Code of 1949,
11 amended June 24, 1981 (P.L.109, No.36), is amended to read:
12 Section 1106. Duty to Employ.--The board of school directors
13 in every school district shall employ the necessary qualified
14 professional employes, substitutes and temporary professional
15 employes to keep the public schools open in their respective
16 districts in compliance with the provisions of this act. Except
17 for school districts of the first class and first class A which
18 may require residency requirements, no other school district
19 shall require an employe to reside within the school district as
20 a condition for appointment or continued employment unless
1 agreed to by the board of school directors and the bargaining 2 unit representing the professional employes. 3 Section 2. The amendment of section 1106 shall only apply to 4 professional employees who are initially employed after the 5 effective date of this amendatory act. 6 Section 3.
