AN ACT 1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An 2 act concerning townships of the second class; and amending, 3 revising, consolidating, and changing the law relating 4 thereto," further providing for the term of office of 5 township supervisors. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 402 of the act of May 1, 1933 (P.L.103, 9 No.69), known as The Second Class Township Code, reenacted and 10 amended July 10, 1947 (P.L.1481, No.567), amended July 13, 1961 11 (P.L.596, No.294), July 30, 1975 (P.L.134, No.67) and May 9, 12 1980 (P.L.118, No.45), is amended to read: 13 Section 402. Officers to Be Elected.--(A) The electors of 14 each township shall elect (a) except as otherwise provided, 15 three supervisors, (b) one assessor, (c) three auditors, and (d) 16 one tax collector. No person shall at the same time hold more 17 than one elective township office: Provided, That the office of 18 justice of the peace shall not be considered an elective 19 township office for the purposes of this section.
1 (B) Upon petition of at least five per centum of the 2 registered electors of the township or pursuant to a resolution 3 of the board of supervisors, and upon an approval by a majority 4 of those electors voting at the next municipal or general 5 election, there shall be elected two additional supervisors. The 6 referendum petition or resolution of the board of supervisors 7 certified by the township secretary shall be filed with the 8 county board of elections not later than the thirteenth Tuesday 9 prior to the next municipal or general election. The county 10 board of elections shall place the question before the electors 11 in the same manner as other questions are presented under the 12 provisions of the Pennsylvania Election Code. 13 The form of the question shall be as follows: 14 Should two additional supervisors be Yes 15 elected to serve in this township? No 16 The county board of elections shall tabulate and publish the 17 results of the referendum within thirty days of the election. 18 The total number of supervisors shall not exceed five. In no 19 event shall the question of additional supervisors be voted on 20 more than once in any three-year period. 21 (C) At the first municipal election following the approval 22 at the prior general election by the voters of the question 23 providing for the election of two additional supervisors, one of 24 such additional supervisors shall be elected for a term of 25 [four] two years and one shall be elected for a term of [six] 26 four years, each to serve from the first Monday of January next 27 following his election. At the first general election following 28 the approval at the prior municipal election by the voters of 29 the question providing for the election of two additional 30 supervisors, one of such additional supervisors shall be elected 19940H2911B3888 - 2 -
1 for a term of [three years] one year and one shall be elected 2 for a term of [five] three years, each to serve from the first 3 Monday of January next following his election. Thereafter, such 4 additional supervisors shall be elected for terms of [six] four 5 years each to serve from the first Monday of January next 6 following his election. 7 Section 2. Section 410(a) of the act, amended November 20, 8 1981 (P.L.337, No.122), is amended to read: 9 Section 410. Supervisors.--(a) Except as is otherwise 10 provided for the election of additional supervisors, at each 11 municipal election, the electors of each township shall elect 12 one supervisor to serve for a term of [six] four years from the 13 first Monday of January next following his election. 14 * * * 15 Section 3.
