AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for dirt and gravel road maintenance. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 9102(a) of Title 75 of the Pennsylvania 6 Consolidated Statutes is amended to read: 7 § 9102. Distribution of State highway maintenance funds. 8 (a) General rule.--[The] Except as provided under sections 9 9106 (relating to dirt and gravel road maintenance) and 9107 10 (relating to State forestry roads), the department shall 11 distribute all highway appropriations and executive 12 authorizations for State highway maintenance in the various 13 county maintenance districts in the following manner: 14 (1) For any fiscal year in which the total highway 15 maintenance appropriations and executive authorizations are 16 equal to the combined total base allocations for all the
1 county maintenance districts, each maintenance district shall 2 receive its base allocation. 3 (2) For any fiscal year in which the total highway 4 maintenance appropriations and executive authorizations are 5 less than the combined total base allocations of all the 6 county maintenance districts, each maintenance district's 7 share shall be reduced, to the extent necessary to bring the 8 total allocation within the funding limits, in the same 9 proportion that each county's base allocations bears to the 10 combined total of all counties' base allocations. 11 (3) For any fiscal year in which the total highway 12 maintenance appropriations and executive authorizations are 13 greater than the combined total base allocations of all the 14 county maintenance districts, the funds shall be distributed 15 based upon the formula in subsection (b), but notwithstanding 16 the formula calculation for any particular county, no county 17 shall receive less than its base allocation in any year. 18 * * * 19 Section 2. Title 75 is amended by adding sections to read: 20 § 9106. Dirt and gravel road maintenance. 21 (a) General rule.--The department shall annually distribute 22 $7,000,000 of the total funds available under section 9102 23 (relating to distribution of State highway maintenance funds) to 24 municipalities for the mitigation of sediment runoff from 25 locally owned dirt and gravel roads. 26 (b) Application.--Municipalities may apply for funding each 27 year in blocks of $5,000 per mile. A municipality may receive a 28 maximum of $10,000 per year in funding. An application to the 29 department's district municipal services supervisors must 30 contain letters from the local county conservation district and 19940H2721B3553 - 2 -
1 the Pennsylvania Fish and Boat Commission in support of the 2 particular project. 3 (c) Training.--The Department of Environmental Resources or 4 the department shall conduct or preapprove a one-week training 5 course for municipal employees on how to mitigate the sediment 6 runoff from dirt and gravel roads. The department shall provide 7 $250 per person for the training course and a maximum of $400 8 for expenses. 9 (d) Priorities.--The department shall prioritize funding for 10 roads located along streams of high quality and exceptional 11 value. The department shall also prioritize funding for those 12 municipalities that have received training. 13 § 9107. State forestry roads. 14 (a) General rule.--The department shall annually distribute 15 $2,000,000 of the total funds available under section 9102 16 (relating to distribution of State highway maintenance funds) to 17 the Department of Environmental Resources for the mitigation of 18 sediment runoff from State forestry roads. 19 (b) Priorities.--The Department of Environmental Resources 20 shall prioritize funding for dirt and gravel roads located along 21 streams of high quality and exceptional value. 22 Section 3.
