                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for proof of financial
     3     responsibility at accident scene and notification to the
     4     Department of Transportation.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 3746 and 3747 of Title 75 of the
     8  Pennsylvania Consolidated Statutes are amended by adding
     9  subsections to read:
    10  § 3746.  Immediate notice of accident to police department.

    12     (d)  Financial responsibility.--A police officer
    13  investigating an accident, whether or not the investigation is
    14  required by this section, shall request that each driver provide
    15  information relating to financial responsibility. If any driver
    16  is unable to provide information relating to financial
    17  responsibility, this fact shall be reported to the department


     1  for purposes of sections 1785 (relating to proof of financial
     2  responsibility following accident) and 3744(a) (relating to duty
     3  to give information and render aid).
     4  § 3747.  Written report of accident by driver or owner.
     5     * * *
     6     (h)  Financial responsibility affidavit.--Any driver or owner
     7  of a vehicle who files a report under this section and who is
     8  not offered or refused proof of financial responsibility as
     9  required under section 3744(a) (relating to duty to give
    10  information and render aid) shall have the right and may file
    11  with the department a sworn affidavit setting forth the
    12  circumstances relating to failure or refusal to offer proof of
    13  financial responsibility. This right shall also extend to
    14  circumstances where financial responsibility was dropped or
    15  canceled. Any affidavit filed under this subsection may be used
    16  by the department for purposes of sections 1785 (relating to
    17  proof of financial responsibility following accident) and
    18  3744(a).
    19     Section 2.  This act shall take effect in 60 days.
