AN ACT
1 Requiring the Commonwealth to pay for certain mental health
2 costs for State-sentenced inmates in State correctional
3 facilities; and making a repeal.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Short title.
7 This act shall be known and may be cited as the State Inmate
8 Mental Health Care Cost Act.
9 Section 2. Cost of State prison mental health treatment for
10 inmates.
11 The Commonwealth shall pay for all costs, payments or
12 expenditures on behalf of any inmate who receives mental health
13 care treatment in a State correctional facility. No costs for
14 mental health care treatment shall be imposed upon the county of
15 their residence.
16 Section 3. Repeals.
17 As much of section 408 of the act of July 9, 1976 (P.L.817,
18 No.143), known as the Mental Health Procedures Act, as relates
1 to State-sentenced inmates held in State correctional
2 institutions is repealed.
3 Section 4. Effective date.
4 This act shall take effect in 60 days.
