AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for removal of vehicles from limited 3 access highways and for the movement of vehicles after an 4 accident on limited access highways. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 75 of the Pennsylvania Consolidated 8 Statutes is amended by adding a section to read: 9 § 3355. Removal of vehicle from limited access highway. 10 (a) General rule.--When an authorized department employee 11 finds a vehicle on a limited access highway in violation of 12 section 3353(a)(2)(vii) (relating to prohibitions in specified 13 places), the employee may move or cause the vehicle to be moved 14 to a position off the highway ROADWAY where the vehicle will not <-- 15 interfere with the normal movement of traffic on the highway <-- 16 ROADWAY, interfere with the maintenance of the highway ROADWAY <-- 17 or constitute a safety hazard. 18 (b) Exception.--This section shall not apply when the
1 vehicle has been involved in an accident resulting in serious 2 injury, as defined in section 1702 (relating to definitions), of 3 any person. In this case, the vehicle shall be moved only when 4 directed by a police officer. 5 Section 2. Section 3743(b) of Title 75 is amended and the 6 section is amended by adding a subsection to read: 7 § 3743. Accidents involving damage to attended vehicle or 8 property. 9 * * * 10 (b) Exceptions.--When an accident occurs on a limited access 11 highway or on the ramp, shoulder, median or adjacent area <-- 12 SHOULDER OR MEDIAN of a limited access highway, each driver <-- 13 shall move his vehicle as soon as possible off the limited 14 access highway or the ramp, shoulder, median or adjacent area <-- 15 SHOULDER OR MEDIAN to the first available point so as not to <-- 16 impede the normal and reasonable movement of traffic on the 17 limited access highway or constitute a safety hazard. 18 [(b) Penalty.--] 19 (c) Penalties.-- 20 (1) Any person violating [this section] subsection (a) 21 is guilty of a summary offense, punishable by a fine of $300 22 or imprisonment for not more than 90 days, or both. 23 (2) Any person violating subsection (b) is guilty of a 24 summary offense, punishable by a fine of $50. 25 Section 3.
