                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting the offering of live
     3     animals as prizes.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 5511.1.  Live animals as prizes prohibited.
     9     (a)  General rule.--No person shall give or offer to give
    10  away any live animal, except fish, as a prize in any drawing,
    11  lottery, contest, sweepstakes or other game.
    12     (b)  Exception.--
    13         (1)  This section shall not apply to any domestic animal
    14     given away in connection with any agricultural, educational


     1     or vocational program sponsored or sanctioned by the
     2     Department of Agriculture.
     3         (2)  The Department of Agriculture shall promulgate the
     4     rules and regulations necessary to provide the conditions and
     5     requirements of live animal offerings under this subsection.
     6     (c)  Penalty.--A violation of this section constitutes a
     7  summary offense punishable by a fine of not more than $250.
     8     Section 2.  This act shall take effect in 60 days.
