                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for dissemination of
     3     telephone numbers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2906.  Dissemination of telephone numbers.
     9     (a)  General rule.--Any telephone call identification service
    10  offered in this Commonwealth by a public utility, or by any
    11  other person, partnership, association or corporation that makes
    12  use of the facilities of a public utility, shall allow a caller
    13  to withhold display of the caller's telephone number from the
    14  telephone instrument of the individual receiving the telephone
    15  call.
    16     (b)  Charge prohibited.--There shall be no charge to the
    17  caller who requests that the caller's telephone number be
    18  withheld.

     1     (c)  Notice.--A public utility offering a call identification
     2  service shall notify its subscribers that their calls may be
     3  identified to a called party at least 30 days before the service
     4  is offered. In the case of a public utility presently offering a
     5  call identification service, notice shall be given within 30
     6  days of the effective date of this act.
     7     (d)  Exceptions.--This section shall not apply to any of the
     8  following:
     9         (1)  An identification service which is used within the
    10     same limited system, including a Centrex or private branch
    11     exchange (PBX) system, as the recipient telephone.
    12         (2)  An identification service which is used on a public
    13     agency's emergency telephone line or on the line which
    14     receives the primary emergency telephone number (911).
    15         (3)  An identification service provided in connection
    16     with legally sanctioned call-tracing or call-tapping
    17     procedures.
    18         (4)  An identification service provided in connection
    19     with any "800" or "900" access code telephone service until
    20     the public utility develops the technical capability to
    21     comply with subsection (a), as determined by the commission.
    22     Section 2.  This act shall take effect immediately.
