                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the licensing requirements of
     3     certain inspection mechanics.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4726(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4726.  Certification of mechanics.
     9     (a)  General rule.--No mechanic shall conduct motor vehicle
    10  inspections or mass transit vehicle inspections at an official
    11  inspection station unless certified as to training,
    12  qualifications and competence by the department or the
    13  department's designate according to department regulations. The
    14  regulations relating to mass transit vehicle inspections shall
    15  require that any mechanic conducting such inspections shall
    16  possess proven competence in the area of mass transit vehicle
    17  operation and maintenance. The provisions of this title or
    18  regulations adopted thereunder shall not be construed or applied

     1  in a manner which would preclude or impair the right of a person
     2  who is a resident of another state, and who is in possession of
     3  a valid driver's license issued by such state, to be certified
     4  to conduct motor vehicle inspections or mass transit vehicle
     5  inspections at an official inspection station in this
     6  Commonwealth. A certified official inspection mechanic
     7  performing a road test on a modular housing undercarriage for
     8  the purpose of conducting a motor vehicle inspection is not
     9  required to hold a commercial driver's license only if the
    10  entire road test is performed on private property provided the
    11  mechanic holds a valid Class C driver's license and the road
    12  test area is of adequate space and size to perform a complete
    13  and proper road test as specified in department regulations. No
    14  official inspection station appointment shall be issued or
    15  renewed unless a certified official inspection mechanic is
    16  employed there.
