AN ACT
1 Providing for restrictions on the use of municipal waste
2 transfer facilities; and imposing duties on the Department of
3 Environmental Resources.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Restriction on use of transfer facilities.
7 (a) Power of governing body.--The governing body of a
8 municipality in a county with municipal waste landfill capacity
9 sufficient to accommodate three times the waste volume generated
10 within the county may prohibit or restrict the use of municipal
11 waste transfer facilities within its municipality.
12 (b) Formula for determining waste-capacity ratio.--The
13 formula for determining generated waste in relationship to
14 capacity shall be based on average daily volume. The Department
15 of Environmental Resources shall certify the amount of waste
16 generated by a county and the permitted waste capacity of
17 landfills within that county.
18 Section 2. Effective date.
1 This act shall take effect in 90 days.
