                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for assistance to an
     6     exceptional child during transportation.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1374 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended January 14, 1970 (1969 P.L.468, No.192), is amended to
    12  read:
    13     Section 1374.  Free Transportation or Board and Lodging.--Any
    14  exceptional child, who is regularly enrolled in a special class
    15  that is approved by the Department of [Public Instruction]
    16  Education, or who is enrolled in a regular class in which
    17  approved educational provisions are made for him, may be
    18  furnished with free transportation by the school district. An
    19  exceptional child who needs physical assistance during
    20  transportation shall be provided with an aide for the entire

     1  trip. When it is not feasible to provide such transportation the
     2  board of school directors may in lieu thereof pay for suitable
     3  board and lodging for any such child. If free transportation or
     4  board and lodging is not furnished for any exceptional child
     5  who, by reason thereof, is unable to attend the class or center
     6  for which he is qualified, the intermediate unit shall provide
     7  the transportation necessary.
     8     Section 2.  This act shall take effect in 60 days.
