AN ACT
1 Amending the act of December 20, 1985 (P.L.457, No.112),
2 entitled "An act relating to the right to practice medicine
3 and surgery and the right to practice medically related acts;
4 reestablishing the State Board of Medical Education and
5 Licensure as the State Board of Medicine and providing for
6 its composition, powers and duties; providing for the
7 issuance of licenses and certificates and the suspension and
8 revocation of licenses and certificates; providing penalties;
9 and making repeals," providing for the regulation of tattoo
10 artists.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. Section 2 of the act of December 20, 1985
14 (P.L.457, No.112), known as the Medical Practice Act of 1985, is
15 amended by adding definitions to read:
16 Section 2. Definitions.
17 The following words and phrases when used in this act shall
18 have the meanings given to them in this section unless the
19 context clearly indicates otherwise:

21 "Facial tattoo." Any tattoo applied above the neck,
1 including eyelids, eyebrows or lips. 2 * * * 3 "Tattoo." The process by which indelible marks or decorative 4 designs are created by introducing pigments beneath the surface 5 of the skin through the use of needles. 6 "Tattoo artist." A person licensed to practice tattooing by 7 the State Board of Medicine. 8 * * * 9 Section 2. The act is amended by adding a section to read: 10 Section 15.1. Tattoo artist. 11 (a) General rule.--A tattoo artist shall act in accordance 12 with regulations authorized by this section. 13 (b) Regulations.--The board shall promulgate regulations for 14 tattoo artists which shall include, but not be limited to: 15 (1) Prohibiting the use of anesthetic injections, other 16 medications and prescription drugs. 17 (2) Prescribing procedures and conditions for 18 sterilization, storage of sterilized equipment, 19 resterilization and disposal of discarded needles and other 20 equipment. 21 (3) Prohibiting application of facial tattoos. 22 (4) Providing for a written examination for certificate 23 applicants. 24 Section 3. Section 22(a) of the act is amended to read: 25 Section 22. Licenses and certificates; general qualification. 26 (a) Types of licenses and certificates.--The board may grant 27 the following licenses and certificates: 28 (1) License without restriction. 29 (2) Interim limited license. 30 (3) Graduate license. 19930H0342B0372 - 2 -
1 (4) Institutional license. 2 (5) Temporary license. 3 (6) Extraterritorial license. 4 (7) Midwife license. 5 (8) Physician assistant certificate. 6 (9) Tattoo artist license. 7 * * * 8 Section 4. The act is amended by adding a section to read: 9 Section 36.1. Tattoo artist license. 10 (a) General rule.--A tattoo artist license empowers the 11 holder to practice tattooing. 12 (b) Requirements.--A tattoo artist license may not be issued 13 to the applicant unless the requirements set forth in this act 14 and rules and regulations issued by the board are met. 15 Section 5.
