AN ACT 1 Authorizing and directing the Department of General Services, 2 with the approval of the Governor and the Department of 3 Corrections, to convey a tract of land in Lower Allen 4 Township, Cumberland County, Pennsylvania, to Lower Allen 5 Township. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of General Services, with the 9 approval of the Governor and the Department of Corrections, is 10 hereby authorized and directed, on behalf of the Commonwealth of 11 Pennsylvania, to grant and convey, for a consideration equal to <-- 12 one-half the fair market value OF $12,000, to Lower Allen <-- 13 Township, the following described tract of land and the 14 improvements erected thereon: 15 All that certain tract or parcel of land, with improvements 16 thereon erected, situate in Lower Allen Township, Cumberland 17 County, Pennsylvania, more particularly bounded and described, 18 to wit:
1 Beginning at a point, an iron pin, said point being the 2 following two courses and distances from the intersection of the 3 easterly legal right-of-way line of St. John's Road and the 4 southern property line of lands of Transcon Lines Corp.: (1) 5 north 72 degrees 04 minutes 49 seconds east a distance of 556.89 6 feet to a stone; (2) north 25 degrees 19 minutes 41 seconds west 7 a distance of 64.85 feet. Thence from said point of beginning 8 along lands now or formerly of Transcon Lines Corp. north 25 9 degrees 19 minutes 41 seconds west a distance of 544.50 feet to 10 a point; thence along lands now or formerly of the Department of 11 Corrections of the Commonwealth north 49 degrees 57 minutes 11 12 seconds east a distance of 400 feet to a point; thence along 13 said lands south 25 degrees 19 minutes 41 seconds east a 14 distance of 544.50 feet to a point; thence along lands now or 15 formerly of Waldo G. Weaver and Jay Smink south 49 degrees 57 16 minutes 11 seconds west a distance of 400 feet to the point of 17 beginning. 18 Containing 210,653.02 square feet or 4.836 acres. 19 Section 2. The conveyance shall be made under and subject to 20 all easements, servitudes and rights of others, including, but 21 not confined to, streets, roadways and rights of telephone, 22 telegraph, water, electric, sewer, gas or pipeline companies, as 23 well as under and subject to any interest, estates or tenancies 24 vested in third persons, whether or not appearing of record, for 25 any portion of the land or improvements erected thereon. 26 Section 3. The deed of conveyance shall contain a clause 27 that the property conveyed shall be used for public or community 28 purposes, including, but not limited to, public safety or 29 recreational purposes, and, if at any time Lower Allen Township 30 conveys, sells or transfers the property or permits the property 19930H0085B0478 - 2 -
1 to be used for any purpose other than those specified in this 2 section, the title to the property shall immediately revert to 3 and revest in the Commonwealth of Pennsylvania. 4 Section 4. The deed of conveyance shall be approved as 5 provided by law and shall be executed by the Secretary of 6 General Services in the name of the Commonwealth of 7 Pennsylvania. 8 Section 5.
