AN ACT
1 Providing for issuance of permits for low-level nuclear waste
2 disposal facilities.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Definitions.
6 The following words and phrases when used in this act shall
7 have the meanings given to them in this section unless the
8 context clearly indicates otherwise:
9 "Municipal waste," "residual waste" or "hazardous waste."
10 The terms shall have the meanings given to them under the act of
11 July 7, 1980 (P.L.380, No.97), known as the Solid Waste
12 Management Act, and the act of July 28, 1988 (P.L.556, No.101),
13 known as the Municipal Waste Planning, Recycling and Waste
14 Reduction Act.
15 "Solid waste disposal facility." A landfill or an
16 incinerator used, or capable of being used, for the disposal of
17 municipal, residual or hazardous waste or any combination
1 thereof.
2 Section 2. Issuance of permits.
3 Notwithstanding any other provision of law, the Department of
4 Environmental Resources shall not issue a permit for the
5 establishment of a low-level nuclear waste disposal facility in
6 any county which has more than one permitted solid waste
7 disposal facility within its borders.
8 Section 3. Effective date.
9 This act shall take effect immediately.
