AN ACT 1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 2 "An act concerning elections, including general, municipal, 3 special and primary elections, the nomination of candidates, 4 primary and election expenses and election contests; creating 5 and defining membership of county boards of elections; 6 imposing duties upon the Secretary of the Commonwealth, 7 courts, county boards of elections, county commissioners; 8 imposing penalties for violation of the act, and codifying, 9 revising and consolidating the laws relating thereto; and 10 repealing certain acts and parts of acts relating to 11 elections," further providing for nomination by political 12 bodies. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 951(e) of the act of June 3, 1937 16 (P.L.1333, No.320), known as the Pennsylvania Election Code, 17 amended April 18, 1985 (P.L.5, No.4), is amended to read: 18 Section 951. Nominations by Political Bodies.--* * * 19 (e) There shall be appended to each nomination paper offered 20 for filing an affidavit of each candidate nominated therein, 21 stating--(1) the election district in which he resides; (2) the 22 name of the office for which he consents to be a candidate; (3) 23 that he is eligible for such office; (4) that he will not
1 knowingly violate any provision of this act, or of any law 2 regulating and limiting election expenses, and prohibiting 3 corrupt practices in connection therewith; (5) [that his name 4 has not been presented as a candidate by nomination petitions 5 for any public office to be voted for at the ensuing primary 6 election, nor has he been nominated by any other nomination 7 papers filed for any such office; (6) that in the case where he 8 is a candidate for election at a general or municipal election, 9 he was not a registered and enrolled member of a party thirty 10 (30) days before the primary held prior to the general or 11 municipal election in that same year; (7)] that, in the case 12 where he is a candidate for election at a special election, he 13 is not a registered and enrolled member of a party. In cases of 14 papers for candidates for the General Assembly, the candidate's 15 affidavit shall state (i) that the candidate will satisfy the 16 eligibility requirements contained in sections 5 and 7 of 17 Article II of the Constitution of Pennsylvania; (ii) (a) that in 18 the case of a candidate for the office of Senator in the General 19 Assembly that the candidate will be twenty-five (25) years of 20 age on or before the first day of the term for which the 21 candidate seeks election or (b) that in the case of a candidate 22 for the office of Representative in the General Assembly that 23 the candidate will be twenty-one (21) years of age on or before 24 the first day of the term for which the candidate seeks 25 election; (iii) that the candidate shall have been a citizen and 26 inhabitant of Pennsylvania four (4) years and an inhabitant of 27 the respective district one (1) year next before the election 28 (unless absent on the public business of the United States or of 29 this State); and (iv) that the candidate has not been convicted 30 of embezzlement of public moneys, bribery, perjury or other 19920H3009B4138 - 2 -
