AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, further providing for protective material and for 3 license eligibility. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 2524 and 2704(b) of Title 34 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 2524. Protective material required. 9 (a) General rule.--Unless further restricted by regulations 10 of the commission, every person hunting for or assisting to hunt 11 for [deer, bear or woodchucks] big game, excluding wild turkey, 12 or small game, excluding migratory waterfowl, shall wear either 13 a minimum of 250 square inches of daylight fluorescent orange- 14 colored material on the back and front combined or, in lieu 15 thereof, a hat of the same color material. The material shall be 16 worn so it is visible in a 360-degree arc. [Unless otherwise 17 specified by regulations of the commission, the]
1 (b) Exceptions.--The provision of this section shall not 2 apply to the following: 3 (1) any season for using muzzle-loading firearms 4 only[,]; 5 (2) any season for hunting wild turkey; or 6 (3) any season for using bows and arrows [only] unless 7 such season overlaps with small game season. 8 [(b)] (c) Penalty.--A violation of this section is a summary 9 offense of the fifth degree. 10 § 2704. Eligibility for license. 11 * * * 12 (b) Hunter education.-- 13 (1) Persons who have not held a hunting license lawfully 14 issued to them in this Commonwealth or another state or 15 nation or have not hunted under the exceptions in section 16 2706 (relating to resident license and fee exemptions) or do 17 not possess a certificate of training approved by the 18 director prior to the enactment of this title shall be 19 required to attain accreditation in a hunter education 20 program approved by the director before a hunting license is 21 issued to them. 22 (2) In addition to taking a general hunter education 23 program, a person who wishes to hunt turkey shall complete 24 successfully, evidenced by a certificate, a course 25 specifically limited to turkey hunting safety which shall be 26 offered by the commission by the beginning of the season in 27 1994 and each year thereafter. A person who issues hunting 28 licenses shall, upon being shown a person's turkey hunting 29 safety course certificate, issue a turkey stamp to the 30 certificateholder, who shall affix the stamp to the license. 19920H2866B3840 - 2 -
1 There shall be no costs or fees charged or collected for the 2 stamp or the course. 3 (3) The provisions of this subsection shall not apply to 4 a person who presents: 5 [(1)] (i) Evidence of service in the armed forces of 6 the United States or in the United States Coast Guard and 7 discharge or separation under honorable conditions within 8 six months of the date of application. 9 [(2)] (ii) Evidence that the person is currently 10 serving in the armed forces of the United States or in 11 the United States Coast Guard. 12 * * * 13 Section 2.
