AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1992, to June 30, 1993, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1992; to provide appropriations from the 8 State Lottery Fund, the Pennsylvania Economic Revitalization 9 Fund, the Energy Conservation and Assistance Fund, the 10 Hazardous Material Response Fund, The State Stores Fund, the 11 Emergency Medical Services Operating Fund and the Milk 12 Marketing Fund to the Executive Department; to provide 13 appropriations from the Judicial Computer System Augmentation 14 Account to the Judicial Department; to provide appropriations 15 from the Motor License Fund for the fiscal year July 1, 1992, 16 to June 30, 1993, for the proper operation of the several 17 departments of the Commonwealth and the Pennsylvania State 18 Police authorized to spend Motor License Fund moneys; and to 19 provide for the appropriation of Federal funds to the 20 Executive and Judicial Departments of the Commonwealth and 21 for the establishment of restricted receipts accounts for the 22 fiscal year July 1, 1992, to June 30, 1993, for the payment 23 of bills incurred and remaining unpaid at the close of the 24 fiscal year ending June 30, 1992, and for the transfer of 25 certain funds. 26 TABLE OF CONTENTS 27 PART I. Effective date. 21 The General Assembly of the Commonwealth of Pennsylvania 22 hereby enacts as follows: 23 PART I 24 GENERAL PROVISIONS 25 Section 101. Short title.--This act shall be known and may 26 be cited as the General Appropriation Act of 1992. 27 Section 102. Definitions.--The following words and phrases 28 when used in this act shall have the meanings given to them in 29 this section unless the context clearly indicates otherwise: 30 "Employees." Includes all directors, superintendents, bureau 19920H2696B3585 - 6 -
1 or division chiefs, assistant directors, assistant 2 superintendents, assistant chiefs, experts, scientists, 3 engineers, surveyors, draftsmen, accountants, secretaries, 4 auditors, inspectors, examiners, analysts, statisticians, 5 marshals, clerks, stenographers, bookkeepers, messengers and 6 other assistants in any department, board or commission. 7 "Expenses" and "maintenance." Includes all printing, binding 8 and stationery, food and forage, materials and supplies, 9 traveling expenses, training, motor vehicle supplies and 10 repairs, freight, express and cartage, postage, telephones and 11 telegraph rentals and toll charges, newspaper advertising and 12 notices, public advertising by or through any medium, fuel, 13 light, heat, power and water, minor construction and renovation, 14 repairs or reconstruction of equipment, buildings and 15 facilities, rent of real estate and equipment, premiums on 16 workmen's compensation, insurance premiums on policies of 17 liability insurance, insurance premiums on medical payment 18 insurance and surety bonds for volunteer workers, premiums on 19 employee group life insurance and employee and retired employee 20 group hospital and medical insurance, payment of Commonwealth 21 share of Social Security taxes and unemployment compensation 22 costs for State employees, the purchase of replacement or 23 additional equipment and machinery and all other incidental 24 costs and expenses, including payment to the Department of 25 General Services of mileage and other charges for the use of 26 automobiles and rental payments for permanently assigned 27 automobiles and of expenses or costs of services incurred 28 through the Purchasing Fund. The term "expenses" also shall 29 include the medical costs for the treatment of inmates of State 30 institutions when the inmate must be transferred to an outside 19920H2696B3585 - 7 -
1 hospital: Provided, That in no case shall the State institution 2 pay more for patient care than that provided under the State 3 medical assistance program. 4 Section 103. Abbreviations.--The following abbreviations 5 when used in this act shall have the meanings given to them in 6 this section unless the context clearly indicates otherwise: 7 "ADA." State appropriations.--(a) General Fund.--The 22 following sums set forth in this act, or as much thereof as may 23 be necessary, are hereby specifically appropriated from the 24 General Fund to the several hereinafter named agencies of the 25 Executive, Legislative and Judicial Departments of the 26 Commonwealth for the payment of salaries, wages or other 27 compensation and travel expenses of the duly elected or 28 appointed officers and employees of the Commonwealth, for the 29 payment of fees for contractual services rendered, for the 30 purchase or rental of goods and services, printing, public 19920H2696B3585 - 9 -
1 advertising by or through any medium, equipment, land and 2 buildings and for payment of any other expenses, as provided by 3 law or by this act, necessary for the proper conduct of the 4 duties, functions and activities and for the purposes 5 hereinafter set forth for the fiscal year beginning July 1, 6 1992, and for the payment of bills incurred and remaining unpaid 7 at the close of the fiscal year ending June 30, 1992. 8 (b) State Lottery Fund.--The following sums set forth in 9 this act, or as much thereof as may be necessary, are hereby 10 specifically appropriated from the State Lottery Fund to the 11 several hereinafter named agencies of the Executive Department 12 of the Commonwealth for the payment of fees for contractual 13 services rendered, for the purchase or rental of goods and 14 services and for payment of any other expenses, as provided by 15 law or by this act, necessary for the proper conduct of the 16 duties, functions and activities and for the purposes 17 hereinafter set forth for the fiscal year beginning July 1, 18 1992, and for the payment of bills incurred and remaining unpaid 19 at the close of the fiscal year ending June 30, 1992. 20 (c) Pennsylvania Economic Revitalization Fund.--The 21 following sums set forth in this act, or as much thereof as may 22 be necessary, are hereby specifically appropriated from the 23 Pennsylvania Economic Revitalization Fund to the several 24 hereinafter named agencies of the Executive Department of the 25 Commonwealth for the payment of fees for contractual services 26 rendered, for the purchase or rental of goods and services and 27 for the payment of any other expenses, as provided by law or by 28 this act, necessary for the proper conduct of the duties, 29 functions and activities and for the purposes hereinafter set 30 forth for the fiscal year beginning July 1, 1992, and for the 19920H2696B3585 - 10 -
1 payment of bills incurred and remaining unpaid at the close of 2 the fiscal year ending June 30, 1992. 3 (d) Energy Conservation and Assistance Fund.--The following 4 sums set forth in this act, or as much thereof as may be 5 necessary, are hereby specifically appropriated from the Energy 6 Conservation and Assistance Fund to the several hereinafter 7 named agencies of the Executive Department of the Commonwealth 8 for the payment of fees for contractual services rendered, for 9 the purchase or rental of goods and services and for the payment 10 of any other expenses, as provided by law or by this act, 11 necessary for the proper conduct of the duties, functions and 12 activities and for the purposes hereinafter set forth for the 13 fiscal year beginning July 1, 1992, and for the payment of bills 14 incurred and remaining unpaid at the close of the fiscal year 15 ending June 30, 1992. 16 (e) Judicial Computer System Augmentation Account.--The 17 following sums set forth in this act, or as much thereof as may 18 be necessary, are hereby specifically appropriated from the 19 restricted receipt account established within the General Fund, 20 known as the Judicial Computer System Augmentation Account, to 21 the Judicial Department of the Commonwealth for the payment of 22 fees for contractual services rendered, for the purchase or 23 rental of goods and services and for the payment of any other 24 expenses, as provided by law or by this act, necessary for the 25 proper conduct of the duties, functions and activities and for 26 the purposes hereinafter set forth for the fiscal year beginning 27 July 1, 1992, and for the payment of bills incurred and 28 remaining unpaid at the close of the fiscal year ending June 30, 29 1992. 30 (f) Emergency Medical Services Operating Fund.--The 19920H2696B3585 - 11 -
1 following sums set forth in this act, or as much thereof as may 2 be necessary, are hereby specifically appropriated from the 3 Emergency Medical Services Operating Fund to the several 4 hereinafter named agencies of the Executive Department of the 5 Commonwealth for the payment of fees for contractual services 6 rendered, for the purchase or rental of goods and services and 7 for the payment of any other expenses, as provided by law or by 8 this act, necessary for the proper conduct of the duties, 9 functions and activities and for the purposes hereinafter set 10 forth for the fiscal year beginning July 1, 1992, and for the 11 payment of bills incurred and remaining unpaid at the close of 12 the fiscal year ending June 30, 1992. 13 (g) The State Stores Fund.--The following sums set forth in 14 this act, or as much thereof as may be necessary, are hereby 15 specifically appropriated from The State Stores Fund to the 16 hereinafter named agency of the Executive Department of the 17 Commonwealth for the payment of fees for contractual services 18 rendered, for the purchase or rental of goods and services and 19 for the payment of any other expenses, as provided by law or by 20 this act, necessary for the proper conduct of the duties, 21 functions and activities and for the purposes hereinafter set 22 forth for the fiscal year beginning July 1, 1992, and for the 23 payment of bills incurred and remaining unpaid at the close of 24 the fiscal year ending June 30, 1992. 25 (h) Motor License Fund.--The following sums, or as much 26 thereof as may be necessary, are hereby appropriated from the 27 Motor License Fund to the hereinafter named agencies of the 28 Commonwealth for the payment of salaries, wages and other 29 compensation and travel expenses of the duly elected or 30 appointed officers and employees of the Commonwealth, for 19920H2696B3585 - 12 -
1 contractual services and other expenses necessary for the proper 2 conduct of the duties, functions and activities for the purposes 3 hereinafter set forth for the fiscal year beginning July 1, 4 1992, and for the payment of bills incurred and remaining unpaid 5 at the close of the fiscal year ending June 30, 1992. 6 (i) Aviation Restricted Revenue Account.--The following 7 sums, or as much thereof as may be necessary, are hereby 8 appropriated from the Aviation Restricted Revenue Account in the 9 Motor License Fund to the hereinafter named agencies of the 10 Commonwealth for the purposes set forth herein for the fiscal 11 year beginning July 1, 1992, and for the payment of bills 12 incurred and remaining unpaid at the close of the fiscal year 13 ending June 30, 1992. 14 (j) Hazardous Material Response Fund.--The following sums 15 set forth in this act, or as much thereof as may be necessary, 16 are hereby specifically appropriated from the Hazardous Material 17 Response Fund to the several hereinafter named agencies of the 18 Executive Department of the Commonwealth for the payment of fees 19 for contractual services rendered, for the purchase or rental of 20 goods and services and for the payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 1992, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 1992. 26 (k) Milk Marketing Fund.--The following sums set forth in 27 this act, or as much thereof as may be necessary, are hereby 28 specifically appropriated from the Milk Marketing Fund to the 29 Milk Marketing Board for the payment of fees for contractual 30 services rendered, for the purchase or rental of goods and 19920H2696B3585 - 13 -
1 services and for the payment of any other expenses, as provided 2 by law or by this act, necessary for the proper conduct of the 3 duties, functions and activities and for the purposes 4 hereinafter set forth for the fiscal year beginning July 1, 5 1992, and for the payment of bills incurred and remaining unpaid 6 at the close of the fiscal year ending June 30, 1992. 7 Section 105. Federal augmentation appropriations.--The 8 following Federal augmentation appropriations set forth in this 9 act, or as much thereof as may be necessary, are hereby 10 specifically appropriated from the Federal augmentation funds to 11 the several hereinafter named agencies of the Executive and 12 Judicial Departments of the Commonwealth for the payment of the 13 expenses of implementing and carrying out the programs stated 14 herein for the fiscal year beginning July 1, 1992, and for the 15 payment of bills incurred and remaining unpaid at the close of 16 the fiscal year ending June 30, 1992. Unless otherwise stated, 17 the appropriations include any carryovers from the prior fiscal 18 year. 19 Section 106. Job Training Partnership Act appropriations.-- 20 The following sums set forth in this act, or as much thereof as 21 may be necessary, are hereby appropriated from the Job Training 22 Partnership Act (JTPA) funds to the several hereinafter named 23 agencies of the Executive Department of the Commonwealth for the 24 payment of the expenses of implementing and carrying out the 25 program stated herein for the fiscal year beginning July 1, 26 1992. 27 Section 107. Block grants.--(a) Appropriation.--The 28 following sums set forth in this act, or as much thereof as may 29 be necessary, are hereby specifically appropriated from the 30 block grant (BG) funds to the several hereinafter named agencies 19920H2696B3585 - 14 -
1 of the Executive Department of the Commonwealth for the 2 purposes, and under the restrictions, for which the funds are 3 provided for the fiscal year beginning July 1, 1992. 4 (b) Small Communities Development Block Grant.--The Small 5 Communities Development Block Grant (SCDBG) is to assist small 6 cities and communities that have a high concentration of 7 impoverished citizens and substandard housing to expand their 8 low and moderate income housing opportunities and to meet 9 community development needs. 10 (c) Community Services Block Grant.--The Community Services 11 Block Grant (CSBG) is to provide a range of services and 12 activities having a measurable and potentially major impact on 13 the causes of poverty in the community or those areas of the 14 community where poverty is a particularly acute problem. In 15 addition, new focus may be placed on the unemployed, both old 16 and new. Local agencies may lower their eligibility requirements 17 for recipients to three months to allow greater flexibility to 18 assure proper consideration of each recipient. 19 (d) Education Consolidation and Improvement Block Grant.-- 20 The Education Consolidation and Improvement Block Grant (ECIBG) 21 will be used for the administration and provision of education 22 programs in accordance with the requirements of the Omnibus 23 Budget Reconciliation Act of 1981 and the 1988-1989 24 reauthorization of ECIA Chapter 2 funds. 25 (e) Preventive Health and Health Services Block Grant.--The 26 Preventive Health and Health Services Block Grant (PHHSBG) is 27 for the provision of preventive health and other health services 28 related to emergency medical comprehensive public health, 29 hypertension, fluoridation, health education, risk reduction, 30 home health, rape crisis and rodent control. 19920H2696B3585 - 15 -
1 (f) Maternal and Child Health Services Block Grant.--The 2 Maternal and Child Health Services Block Grant (MCHSBG) is to 3 assure mothers and children access to quality maternal and child 4 health services, to reduce infant mortality and the incidence of 5 preventable disease and handicapping conditions among children, 6 to provide rehabilitative services for blind and disabled 7 individuals under the age of 16 receiving Supplemental Security 8 Income benefits and to provide medical services for children 9 with crippling conditions. 10 (g) Alcohol and Drug Abuse and Mental Health Services Block 11 Grant.--The Alcohol and Drug Abuse and Mental Health Services 12 Block Grant (ADAMHSBG) will be used for the administration and 13 provision of drug and alcohol abuse services and community 14 mental health services in accordance with the requirements of 15 the Omnibus Budget Reconciliation Act of 1981. 16 (h) Low-Income Home Energy Assistance Block Grant.--The Low- 17 Income Home Energy Assistance Block Grant (LIHEABG) is to help 18 lessen the impact of the high cost of energy on low-income 19 families and individuals, including energy efficiency grants for 20 low-income dwellings. 21 (i) Social Services Block Grant.--The Social Services Block 22 Grant (SSBG) is for the provision of social services to eligible 23 persons. 24 (j) Child Care and Development Block Grant.--The Child Care 25 and Development Block Grant (CCDBG) is for the provision of 26 direct child care or to increase the availability of child care 27 for low-income families. 28 Section 108. 6 (b) State Lottery Fund.--The General Assembly hereby
7 estimates that $806,868,000 in State funds, and $57,553,000 in
8 Federal funds will be available from the State Lottery Fund. Of
9 the amount of State funds, $434,328,000 is assumed for executive
10 authorizations.
11 (c) Pennsylvania Economic Revitalization Fund.--The General
12 Assembly hereby estimates that $55,700,000 $62,336,000 in State <--
13 funds and no Federal funds will be available from the
14 Pennsylvania Economic Revitalization Fund. Of the amount of
15 State funds, $5,000 is assumed for executive authorizations.
16 (d) Energy Conservation and Assistance Fund.--The General
17 Assembly hereby estimates that $6,318,000 in State funds and no
18 Federal funds will be available from the Energy Conservation and
19 Assistance Fund. Of the amount of State funds, none is assumed
20 for executive authorizations.
21 (e) Judicial Computer System Augmentation Account.--The

25 (f) Emergency Medical Services Operating Fund.--The General

1 shall receive less than 75% of the 2 actual reimbursement for court costs 3 provided to them from funds 4 appropriated for the fiscal year July 5 1, 1980, to June 30, 1981. 6 For the purpose of determining the 7 actual direct costs incurred by the 8 counties in the administration and 9 operation of the courts of common 10 pleas, the costs as reported to the 11 Department of Community Affairs in the 12 county's annual audit and financial 13 report forms under the heading "(a) 14 Judicial," but confined to the 15 subheading "(4184) courts, excluding 16 capital outlay," shall be used. If a 17 city coterminous with a county does 18 not report on the Department of 19 Community Affairs' form, its figures 20 from the same subheading, set forth in 21 the department forms, shall be used. 22 All payments for reimbursement 23 shall be made to the county treasurer 24 and, in cities of the first class 25 coterminous with counties of the first 26 class, to the city treasurer. 27 In making allocations and payments 28 hereunder, the Court Administrator of 29 Pennsylvania shall exclude all costs 30 which are not properly reportable 19920H2696B3585 - 161 -

Appropriation of prior unspent Federal 5 funds.--Any Federal money which has been previously appropriated 6 by the General Assembly and authorized or allocated by the 7 Federal Government but remains unspent from prior fiscal years, 8 and will not be renewed for fiscal year 1992-1993, is hereby 9 appropriated. 10 Section 1304. Subgrants between Federal fund 11 appropriations.--With the exception of Federal money received 12 under JTPA and SSBG, subgrants may be made between 13 appropriations without further approval of the General Assembly. 14 The Secretary of the Budget shall submit a list of subgrants to 15 the Chairmen of the House and Senate Appropriations Committees 16 quarterly. No subgrant to a State agency, however, may be made 17 from a restricted receipt account without a specific 18 appropriation by the General Assembly. 19 Section 1305. Utilization of emergency Federal funds.--(a) 20 Federal funds available for costs and damages resulting from 21 natural disasters or civil disobedience may be added to an 22 appropriation contained in this act or to funds appropriated or 23 may be used for the purposes prescribed by the Federal 24 Government. 25 (b) In addition to the moneys appropriated by this act, all 26 moneys received from the Federal Government for the purpose of 27 disaster assistance or relief shall be paid into the General 28 Fund and are hereby appropriated out of the General Fund to the 29 departments, boards, commissions or agencies designated by the 30 Governor. 19920H2696B3585 - 181 -
1 (c) In the event of any emergency situation in which the 2 General Assembly cannot act in sufficient time, the Governor is 3 authorized through executive authorization to provide up to 4 $5,000,000 in Federal funds to alleviate the emergency 5 situation. For the purposes of this section, "emergency" is 6 defined as any situation in which there is a chance of, or which 7 may result in, substantial human suffering. 8 PART XIV 9 MISCELLANEOUS PROVISIONS 10 Section 1401. Prior laws unaffected.--This act is not 11 intended to be inconsistent with or to repeal any provision of 12 any act enacted at this or any prior session of the General 13 Assembly regulating the purchase of supplies, the ordering of 14 printing and binding, the purchase, maintenance and use of 15 automobiles, the method of making payments from the State 16 Treasury for any purpose or the functioning of any 17 administrative department, board or commission. 18 Section 1402. Compliance with other law before funds 19 available.--No appropriation made by this act to any department, 20 board, commission or agency of the Executive Department shall be 21 available unless and until the department, board, commission or 22 agency has complied with sections 615 and 616 of the act of 23 April 9, 1929 (P.L.177, No.175), known as The Administrative 24 Code of 1929. 25 Section 1403. Contracts prerequisite to encumbering or 26 committing funds.--Funds for the purchase of supplies, materials 27 and equipment shall not be deemed to be committed or encumbered 28 until contracts covering the purchase have been entered into 29 with the vendors. 30 Section 1404. Appropriation of funds from miscellaneous 12 sources.--(a) In addition to the amounts appropriated by this 13 act, moneys received in payment for food and household supplies 14 furnished to employees and other persons, except inmates, by an 15 institution, and moneys received from the proceeds from the sale 16 of any products of the soil, meats, livestock, timber or other 17 materials sold by the department shall be paid into the General 18 Fund and are hereby appropriated out of the General Fund to the 19 several respective institutions for the operation and 20 maintenance of the institutions. 21 (b) In addition to the amounts appropriated by this act, all 22 moneys received from any other source, except the Federal 23 Government, as contributions for the programs provided herein or 24 as payment for services or materials furnished by one 25 institution to another, except those collections designated as 26 revenues, shall be paid into the General Fund and are hereby 27 appropriated out of the General Fund for the purposes of the 28 respective appropriations. 29 (c) In addition to any funds specifically appropriated by 30 this act, all moneys received by a department or agency of the 19920H2696B3585 - 183 -
1 Commonwealth from any other sources, except the Federal 2 Government, as contributions or supplements to the department or 3 agency for a program or administration of an act included in 4 this act shall be paid into the General Fund and credited to the 5 appropriation for that program or administration of the act. 6 Section 1406. Restriction on Governor's Schools of 7 Excellence.--No Federal, State or other funds shall be used to 8 support the operations of the Governor's Schools of Excellence 9 other than those funds specifically appropriated for such 10 purpose in section 212. 11 Section 1407. Contract terms.--No funds from an 12 appropriation made by this act shall be made available for 13 expenditure after October 1, 1992, unless the department, board, 14 commission, agency or institution has included in all new 15 contracts entered into after October 1, 1992, language as 16 prescribed by the Department of Public Welfare relative to 17 hiring welfare clients, and the department, board, commission, 18 agency or institution is making a good faith effort to increase 19 the hiring of welfare clients. The Department of Public Welfare 20 shall give written notification of compliance to the State 21 Treasurer. 22 Section 1408. Lapsing of unused funds.--(a) Except as 23 otherwise provided by law or in this section, that part of all 24 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X and 25 XI unexpended, uncommitted or unencumbered as of June 30, 1993, 26 shall automatically lapse as of that date. 27 (b) The appropriation in Part II to the Department of 28 Commerce for industrial resource centers shall be a two-year 29 continuing appropriation. 30 (c) The appropriations in Part II to the Department of 19920H2696B3585 - 184 -
1 Community Affairs for housing and redevelopment assistance, 2 enterprise development and low-interest local government loans 3 shall be two-year continuing appropriations. 4 (d) The appropriation in Part II to the Department of 5 Education for JTPA matching funds shall be a two-year continuing 6 appropriation. 7 (e) The appropriations in Part II to the Department of 8 Environmental Resources for the Chesapeake Bay Pollution 9 Abatement Program, and the black fly control program shall be 10 continuing appropriations. 11 (f) The appropriation in Part II to the Department of 12 Military Affairs for the Veterans' Memorial Commission shall be 13 a two-year continuing appropriation. 14 (g) The appropriation in Part II to the Pennsylvania Higher 15 Education Assistance Agency for urban and rural loan forgiveness 16 shall be a two-year continuing appropriation. 17 (h) The appropriations in Part II to the Legislative 18 Department shall be continuing appropriations. 19 (i) The appropriation in Part IV to the Department of 20 Community Affairs for the Recreation Improvement and 21 Rehabilitation Act shall be a three-year continuing 22 appropriation. 23 (j) The appropriation in Part IV to the Department of 24 Community Affairs for housing and redevelopment economic set- 25 aside shall be a two-year continuing appropriation. 26 (k) The appropriation in Part IV to the Department of Labor 27 and Industry for the Pennsylvania Conservation Corps shall be a 28 two-year continuing appropriation. 29 (l) The appropriation in Part IV to the Department of 30 Commerce for business infrastructure development shall be a two- 19920H2696B3585 - 185 -
1 year continuing appropriation. 2 (m) The appropriation in Part V to the Pennsylvania Energy 3 Office shall be a two-year continuing appropriation. 4 (n) The appropriations in section 921 of Part IX for airport 5 development, runway rehabilitation, business airport grants and 6 real estate tax rebate payments shall be two-year continuing 7 appropriations. 8 (o) Notwithstanding the provisions of subsection (f) of 9 section 606 of the act of July 1, 1981 (P.L.628, No.5A), known 10 as the General Appropriation Act of 1981, the appropriation in 11 Part IV of that act to the Legislative Reapportionment 12 Commission shall be a continuing appropriation. 13 PART XV 14 EFFECTIVE DATE 15 Section 1501.
