                                     AN ACT

     1  Requiring the Commonwealth to make certain penalty payments for
     2     certain Commonwealth annuitants.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Termination of certain optional health insurance
     6                 coverage.
     7     Notwithstanding any law, regulation, Executive Board
     8  decision, administrative directive or decision of the Board of
     9  Trustees for the Pennsylvania Employees' Benefit Trust Fund, the
    10  termination of the option to continue the Blue Shield portion of
    11  Basic Health Coverage in lieu of Medicare Part B coverage shall
    12  only apply to those Commonwealth annuitants covered by the
    13  Pennsylvania Employees' Benefit Trust Fund who retire on or
    14  after July 1, 1992.

     1  Section 2.  Commonwealth responsibility to certain annuitants.
     2     The Commonwealth shall be responsible for and liable for the
     3  payment of any penalty which may be assessed against an
     4  annuitant who retired or retires prior to July 1, 1992, or who
     5  was or shall be placed on disability prior to July 1, 1992, and
     6  has enrolled in Medicare Part B coverage as a result of the
     7  withdrawal of the option to retain the Blue Shield portion of
     8  Basic Health Coverage.
     9  Section 3.  Applicability.
    10     This act shall apply to all annuitants who retire or retired
    11  prior to July 1, 1992.
    12  Section 4.  Effective date.
    13     This act shall take effect immediately.
