AN ACT
1 Amending the act of September 2, 1961 (P.L.1232, No.540),
2 entitled "An act providing for the regulation of credit life
3 insurance and credit accident and health insurance;
4 conferring powers and imposing duties on the Insurance
5 Commissioner and prescribing penalties," providing for
6 nondiscrimination in credit life or accident and health
7 insurance policies.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 3 of the act of September 2, 1961
11 (P.L.1232, No.540), known as the Model Act for the Regulation of
12 Credit Life Insurance and Credit Accident and Health Insurance,
13 is amended to read:
14 Section 3. Nondiscrimination; Forms of Credit Life Insurance
15 and Credit Accident and Health Insurance.--(a) No
16 discrimination by reason of the race, religion, nationality or
17 ethnic group, age, sex, family size, occupation, place of
18 residence or marital status of applicant shall be employed to
19 issue or not issue a policy of credit life insurance or credit
1 health and accident insurance.
2 (b) Credit life insurance and credit accident and health
3 insurance shall be issued only in the following forms:
4 (1) Individual policies of life insurance to insure the
5 lives of debtors on the term plan.
6 (2) Individual policies of accident and health insurance to
7 insure debtors on a term plan or disability benefit provisions
8 in individual policies of credit life insurance.
9 (3) Group policies of life insurance issued for delivery to
10 creditors providing insurance upon the lives of debtors on the
11 term plan.
12 (4) Group policies of accident and health insurance issued
13 for delivery to creditors on a term plan insuring debtors or
14 disability benefit provisions in group credit life insurance
15 policies to provide such coverage.
16 Section 2. This act shall take effect in 60 days.
