AN ACT
1 Amending the act of September 30, 1961 (P.L.1778, No.712),
2 entitled, as amended, "An act regulating the practice of
3 lobbying and providing penalties," further providing for
4 penalties; and making an editorial change.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Sections 7.1 and 7.2 of the act of September 30,
8 1961 (P.L.1778, No.712), known as the Lobbying Registration and
9 Regulation Act, added October 7, 1976 (P.L.1051, No.212), are
10 amended to read:
11 Section 7.1. Contingent Compensation [Forbidden]
12 Prohibited.--No person shall compensate, or incur an obligation
13 to compensate, any person to engage in lobbying, and no person
14 shall engage or agree to engage in lobbying, for compensation
15 contingent in whole or in part upon:
16 (1) the passage or defeat, or approval or veto, of any
17 legislation; or
18 (2) the occurrence or nonoccurrence of any formal action by
1 an agency. 2 Section 7.2. Penalty.--(a) Any natural person violating 3 section 7.1 shall be guilty of a felony of the third degree and, 4 upon conviction, shall be disqualified to act as a lobbyist for 5 a period of ten years from the date of conviction and shall be 6 sentenced to pay a fine not exceeding fifteen thousand dollars 7 ($15,000) or to undergo imprisonment not exceeding seven years, 8 or both. Any person, other than a natural person, violating 9 section 7.1 shall be guilty of a felony of the third degree and, 10 upon conviction, shall be sentenced to pay a fine not exceeding 11 twenty-five thousand dollars ($25,000). 12 (b) Any natural person violating any of the provisions of 13 this act other than section 7.1 shall be guilty of a misdemeanor 14 of the third degree and, upon conviction, shall be disqualified 15 to act as a lobbyist for a period of five years from the date of 16 conviction and may be sentenced to pay a fine not exceeding two 17 thousand five hundred dollars ($2,500) or to undergo 18 imprisonment not exceeding one year, or both. Any person, other 19 than a natural person, violating any of the provisions of this 20 act other than section 7.1 shall be guilty of a misdemeanor of 21 the third degree and, upon conviction, shall be sentenced to pay 22 a fine not exceeding two thousand five hundred dollars ($2,500). 23 Section 2.
