                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     selection of prospective jurors.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4521(a) and (f) of Title 42 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 4521.  Selection of prospective jurors.
     9     (a)  Preparation of master list of prospective jurors.--At
    10  least annually the jury selection commission shall prepare a
    11  master list of prospective jurors. The list shall contain all
    12  [voter registration lists for] persons who pay taxes or are
    13  assessed for taxes imposed by any political subdivision within
    14  the county, which lists may be incorporated by reference, or
    15  names from such other lists which in the opinion of the
    16  commission will provide a number of names of prospective jurors
    17  which is equal to or greater than the number of names contained


     1  in the voter registration list. The commission may, but will not
     2  be required to, supplement the master list of prospective jurors
     3  to include, without being limited to, persons in any of the
     4  following categories:
     5         (1)  Persons listed in telephone, city, municipal
     6     directories and similar directories.
     7         [(2)  Persons who pay taxes or are assessed for taxes
     8     imposed by any political subdivisions.
     9         (3)] (2)  Persons in the county participating in any
    10     State, county or local program authorized by law and, to the
    11     extent such names are available, persons participating in any
    12     Federal program authorized by law.
    13         [(4)] (3)  Persons who are on school census lists.
    14         [(5)] (4)  Any other person whose name does not appear in
    15     the master list of prospective jurors and who meets the
    16     qualifications for jurors set forth in this chapter and who
    17     makes application to the commission to be listed on the
    18     master list of prospective jurors.

    20     (f)  Compelling compliance with section.--On application by
    21  the commission, the court shall compel compliance with
    22  subsections (a)(2)[, (3) and (4)] and (3) and (d). Officials of
    23  political subdivisions and Commonwealth officials having
    24  custody, possession or control of lists of names described in
    25  this section shall, upon request of the commission, make such
    26  lists available to the commission for inspection, reproduction
    27  and copying but shall not be required or permitted to:
    28         (1)  provide the commission with information other than
    29     the name, mailing address and municipality of residence of
    30     such person; or

     1         (2)  provide the commission with or otherwise disclose
     2     records or information which the Attorney General by
     3     regulation determines to be privileged from disclosure.
     4     Section 2.  This act shall take effect in 60 days.
